Former Environment Minister Lefter Koka, prosecuted and accused by SPAK for the incinerator files, may be released from prison.

It is learned that Koka has filed a request with the Criminal Court for immediate release and termination of security measures, claiming that the 3-year detention period for the Fier incinerator has expired.

Regarding this request by Koka's defense attorneys based on Article 263, point 6/C of the Criminal Procedure Code, the GJKKO has postponed the decision-making to October 24.

It turns out that in July of this year, the former minister was granted parole by the Durrës Court for the Elbasan incinerator case, where he was sentenced to 6 years and 8 months in prison with a summary trial.

The decision of Durrës judge Xhevdet Lika states that for the remainder of the sentence, Koka must maintain contact with the probation service and not commit other criminal offenses.

But Koka has also been convicted for two other incinerator files, Fier (which was returned for retrial in the GJKKO Appeal by the Supreme Court) and the Tirana incinerator (which has not yet been finalized).

For Fier, in the first instance of the GJKKO, Lefter Koka was sentenced to 6.8 years in prison, while for Tirana, he was sentenced to 2 years in prison with a summary trial.

For Tirana, Koka claims that he has exhausted his sentence, with the time spent in detention, referring to Article 261 of the Code of Criminal Procedure, point 1/C, which provides for the termination of the security measure.
