Investigations against Jurgis Çyrbe closed, SPAK sends former SP MP for

Çyrba is accused by SPAK of "Revealing state secrets", "Supporting the perpetrator of the crime" and "Active corruption in elections". 


The Special Prosecution Office against Corruption and Organized Crime (SPAK) has completed the investigations and sent former socialist MP Jurgis Çyrbja, Ahmet Masha and Altin Hajri for trial.  

Çyrbja is accused by SPAK of "Revealing state secrets", "Supporting the perpetrator of the crime" and "Active corruption in elections". Çyrbja is also said to have used his influence as a member of parliament to obtain information from the TIMS system about several people wanted for various criminal offenses, such as Atin Hajri, with whom he was friends.  

SPAK further explains that Çyrbja, due to his position as a member of parliament, offered and promised the defendant, Altin Hajri, that he would exert influence on law enforcement agencies (police and prosecutor), in exchange for electoral support, a pact that was accepted by Altin Hajri.  

"The defendant Jurgis Çyrbja, due to his function as a member of parliament, offered and promised the defendant, Altin Hajri, that he would exert influence on law enforcement agencies (police and prosecutor), in exchange for electoral support, thereby consuming the elements of the criminal offense of "Active corruption in elections", provided for by Article 328 of the Criminal Code. 

On the other hand, the defendant Altin Hajri, by accepting the favors offered by the defendant Jurgis Çyrbja, but in exchange for voting in his favor, as well as the commitment to secure his votes, has consumed elements of the criminal offense of "Passive Corruption in Elections", provided for by Article 328/bi of the Criminal Code ", SPAK's announcement states. 

The investigations resulted in 8 different episodes, during the period May 2020 to March 2021, where data in the "TIMS" system on a wanted person, as well as some secret information of the General Directorate of the State Police, were made known. This information was mainly related to police plans to capture wanted persons. 

" From the entirety of the investigative actions carried out, it has resulted and been proven that the defendants in 8 (eight) different episodes, during the period from 1.5.2020 to 8.3.2021, were made aware of data in the "TIMS" system, on a wanted person, as well as of some secret information of the General Directorate of the State Police. This information was related to its plans throughout the territory of the Republic of Albania, but also in the Durrës District, for the capture of wanted persons, for the commission of elements of criminal offenses within the framework of organized crime. 

This information, which was provided by the defendants, was transmitted to the wanted persons, consuming the elements of the criminal offense "Revelation of state secrets by citizens", committed in collaboration (according to the respective episodes), provided for by articles 295/1 and 25 of the Criminal Code ", SPAK's announcement states. 

SPAK further adds that with the help of the Dutch authorities, Europol and Eurojust, it was possible to decrypt the SKY and matrix applications with which Çyrbja and Hajri communicated. From these messages, the places and people with whom Çyrbja met to obtain information about Hajri were revealed. 

" From the analysis of some of the communications, it has been proven that during the period October - December 2024, the defendant, Altin Hajri and his interlocutors, discuss the moment of execution of the personal security measure against the defendants: Jurgis Çyrbja and Ahmet Masha, (dated 20.10.2024 and onwards). The content of the communications evidences the acquaintance between the defendants, the affirmation of the content of the communications developed between them through the encrypted platform "SkyEcc", as well as the illegal actions committed in the episodes subject to the accusation, where the meeting places they held with police officers, who also informed them about the operations developed to capture the wanted persons , are also affirmed," SPAK states. 

SPAK's full announcement:  

The Special Prosecution Office against Corruption and Organized Crime has completed the investigations and sent to the Special Court of First Instance the request for the trial of criminal proceedings No. 93/1 of 2024, against the defendants: 

1. Jurgis Çyrbja accused of consuming elements of criminal offenses: 

i. "Revelation of state secrets by citizens", committed more than once (in episodes on the dates; 2.12.2020, 29.12.2020, 25.2.2021, 6.3.2021, 6.3.2021, 6.3.2021 and 7.3.2021), provided for by Article 295/1 of the Criminal Code. 

ii. "Supporting the perpetrator of the crime", committed more than once (in the episodes of the dates; 2.12.2020, 29.12.2020, 25.2.2021 and 7.3.2021), provided for by Article 302/1/2 of the Criminal Code. 

iii. "Revelation of state secrets by citizens", committed in collaboration (in the episode dated 6.3.2021), provided for by articles 295/1 and 25 of the Criminal Code. 

iv. "Supporting the perpetrator of the crime", committed in collaboration (in the episode dated 6.3.2021) provided for by articles 302/1 and 25 of the Criminal Code. 

v. “Active corruption in elections”, provided for by Article 328 of the Criminal Code (in the period between 5.3.2021-8.3.2021). 

2. Ahmet Masha, accused of consuming elements of criminal offenses: 

i. "Revelation of state secrets by citizens", committed in collaboration (in the episode dated 6.3.2021), provided for by articles 295/1 and 25 of the Criminal Code. 

ii. "Supporting the perpetrator of the crime", committed in collaboration (in the episode dated 6.3.2021), provided for by articles 302/1 and 25 of the Criminal Code. 

3. Altin Hajri, i akuzuar për konsumimin e elementëve të veprave penale të mëposhtme: 
i. “Korrupsion pasiv në zgjedhje”, parashikuar nga neni 328/b i Kodit Penal (në periudhën midis datave 1.12.2020 – 8.3.2021) 

ii. “Tregim i sekretit shtetëror nga shtetasit”, parashikuar nga neni 295/1 i Kodit Penal (në episodin e datës 1.5.2020). 
Nga aktet e administruara për këtë procedim penal, ka rezultuar e provuar se të pandehurit; Jurgis Çyrbja, Ahmet Masha dhe Altin Hajri, si dhe bashkëpunëtorë të tjerë kanë koordinuar aktivitete të ndryshme kriminale edhe përmes komunikimeve në platformën e enkriptuar “SkyEcc”. I pandehuri Altin Hajri ka qenë përdorues edhe i platformës tjetër të enkriptuar, “Matrix”. 

Nga tërësia e veprimeve të kryera hetimore, ka rezultuar e provuar se të pandehurit në 8 (tetë) episode të ndryshme, gjatë periudhës 1.5.2020 deri në datë 8.3.2021, janë vënë në dijeni të të dhënave në sistemin “TIMS”, mbi një person të shpallur në kërkim, si edhe të disa informacioneve sekrete të Drejtorisë së Përgjithshme të Policisë së Shtetit. Këto informacione lidheshin me planet e saj në të gjithë territorin e Republikës së Shqipërisë, por edhe në Qarkun e Durrësit, për kapjen e personave të shpallur në kërkim, për kryerjen e elementëve të veprave penale në kuadër të krimit të organizuar. 

Këto informacione që u siguruan nga të pandehurit, u janë transmetuar personave të shpallur në kërkim, duke konsumuar elementët e veprës penale “Tregim i sekretit shtetëror nga shtetasit”, kryer në bashkëpunim (sipas episodeve respektive), parashikuar nga nenet 295/1 dhe 25 të Kodit Penal. 

Ndërsa, komunikimet që të pandehurit kanë zhvilluar me bashkëbiseduesit e tyre, përmes aplikacionit të enkriptuar “SkyEcc”, (konfirmuar dhe nga aktet e dosjes se ishte persona të shpallur në kërkim ndërkombëtar), u kanë shërbyer si një e dhënë e rëndësishme për të qëndruar të fshehur dhe për t’i shpëtuar kapjes apo arrestimit nga strukturat e policisë, duke konsumuar edhe elementët e veprës penale, “Përkrahje e autorit të krimit”, kryer në bashkëpunim, parashikuar nga nenet 302/1 e 25 të Kodit Penal. 

Nga analiza e komunikimeve të platformave të enkriptuara “SkyECC” dhe “Matrix” ka rezultuar se i pandehuri, Jurgis Çyrbja, gjatë periudhës objekt hetimi ka qenë i zgjedhur deputet i Kuvendit të Republikës së Shqipërisë (në legjislaturën 2017-2021), por është zgjedhur deputet edhe në legjislaturën, 2021-2025, deri në momentin e depozitimit të dorëheqjes (datë 9 tetor 2024). 

Në periudhën objekt hetimi, ky i pandehur ka pasur marrëdhënie të ngushtë miqësore me të pandehurin, Altin Hajri, (person i shpallur në kërkim ndërkombëtar për kryerjen e veprave shumë të rënda penale).

On the other hand, the defendant Altin Hajri, by accepting the favors offered by the defendant Jurgis Çyrbja, but in exchange for voting in his favor, as well as the commitment to secure his votes, has consumed elements of the criminal offense of "Passive Corruption in Elections", provided for by Article 328/bi of the Criminal Code. 

In the interests of this criminal proceeding, it has been possible to execute a letter of demand addressed to the Dutch justice authorities for several users of the encrypted platform "Matrix". 

From the analysis of some of the communications, it has been proven that during the period October - December 2024, the defendant, Altin Hajri and his interlocutors, discuss the moment of execution of the personal security measure against the defendants: Jurgis Çyrbja and Ahmet Masha, (dated 20.10.2024 and onwards). The content of the communications evidences the acquaintance between the defendants, the affirmation of the content of the communications developed between them through the encrypted platform "SkyEcc", as well as the illegal actions committed in the episodes subject to the accusation, where the meeting places they held with police officers are also affirmed, who have also informed them about the operations developed to capture the wanted persons. 

From the analysis of the acts administered up to this moment, there are reasonable suspicions, based on evidence, that public officials, in violation of the regular fulfillment of their duties in 8 (eight) cases, have disclosed acts, defined as "state secrets" by law, since their content results in the fact that the defendants under trial were also made aware of them, consuming the elements of the criminal offense "Disclosure of secret acts or data", provided for by Article 295/a/1 of the Criminal Code. 

In order to identify the associates of the defendants: Jurgis Çyrbja, Ahmet Masha and Altin Hajri, as well as public officials who have disclosed acts defined by law as "state secrets", the Special Prosecution Office has proceeded with the separation of the acts of criminal proceedings, no. 93/1 of 2024 into the proceedings with no. 93/1.1 of 2025. The investigations regarding this proceeding continue. 

Special thanks are extended to the French, Dutch, Belgian justice authorities, Eurojust and Europol, who have supported and assisted SPAK in this criminal proceeding.
