Journalist Eni Ferhati said that the investigations against former minister Ilir Beqaj regarding the sterilization affair led to a clash between judge Erion Bani and prosecutors Kondili and Nakuçi.
In an interview for the "Te Paespozuarit" show, he said that the judge recommended that Beqaj be sentenced to "prison detention" and that one more charge be added to what the two prosecutors have done.
Ferhati said that this clash actually happened within SPAK and that Altin Dumani asked the prosecutor Kondili to deepen the investigation.
" The judge took care to underline that the court cannot give a higher measure than what the prosecutor requests. We are familiar with the judge's decision. What has happened is this, a second amnesty for Mr. Beqaj. An operation was performed in August, where Mr. Beqaj's name did not appear anywhere, but only the deputy minister. This is where the first amnesty started. The court said there is room to prosecute Ilir Beqaj and Shkëlqim Cani and a number of other officials.
We come to the last moment, the court suggests, because it has no right to order. The judge of the preliminary session can return the file. Judge Bani says that Mr. Beqaj should also be charged with forgery of documents, seals and stamps. Beqaj as the holder, it is suspected that during the negotiation of the contract, the data of the contract was changed, burdening the position of the state, causing the obligations related to energy, water, and the environment to be taken over by the state.
In short, the court said, Beqaj should be in prison, but I have nothing to do. This is a hot potato. There was not only a clash between the court and the prosecutors, but there was also a reaction from the head of SPAK, Mr. Altin Dumani, who apparently did not agree with this decision of the two prosecutors Kondili and Nakuçi.
There was also an initiative by the head of SPAK, who used the non-binding recommendation telling subordinates that this file has problems. It was a forgotten file and apparently it was not properly investigated ," said journalist Ferhati.
