A clash occurred between judge Erion Bani and two SPAK prosecutors who are investigating Ilir Beqaj's role in the "sterilization affair".
For the second time, the judge has insisted, recommending that Beqaj should in fact be under "prison arrest" and that there should be a second charge against him.
Invited to the show "Te Paespozuarit" on MCN TV, Neritan Sejamini has explained what the judge has specifically found to be wrong with the investigations on Beqaj.
" I was very impressed by the explanation that the judge made because he caught an economic thing, so well done.
What has Mr. Bani done? The state must buy goods, what the state does is set the budget and criteria for this. This is simple procurement. Yes, you can make a road, etc. However, there are cases when the state cannot build roads and cooperates with the private sector.
In order to cooperate, it is done by concession, private performs a part of the service and is paid, either by those who use the service or from the state budget.
For a concession to be made, it means that the risk will pass from the state to the private sector.
The state has said so, I don't have money for the concession, I give it to the private sector, I have this budget. He said within this fund you will do everything.
After that and here the judge caught him. He says that after the tender ended, they started to renegotiate it, set conditions and removed the limit. From 86 million euros, it has gone over 100 million euros. Likewise, the state will pay for energy, water, etc.
The judge says that a formal concession has been made, but de facto it is a simple procurement. So the competition is in vain, because with these conditions, many companies could enter. That's why he says it's intentional ," Sejamini said, among other things.
