The Prosecutor's Office of Tirana appealed the release of former KLA fighter Dritan Goxhaj, requesting his return to prison and the execution of the Special Court of Kosovo for his extradition.
The lottery has appointed Ilir Pandë as the judges who will examine the request in the Supreme Court, while a date and time for the court session has not yet been set.
In the scope of the recourse, the acceptance of the provision of legal aid to the Office of the Specialized Prosecutor of Kosovo and the execution of the Letter is required.
Also required:
- The determination of the coercive measure of personal security "Arrest in prison" for the purpose of extradition.
- Allowing the personal control of the citizen Dritan Goxhaj, his residence and the place of his arrest, as well as the seizure of materials during their control.
The request sets forth the object of setting the date and place of the extradition procedure as well as allowing the representatives of the Specialized Chambers of Kosovo to be present and observe the relevant Albanian judicial procedures in relation to the implementation of this request for cooperation and assistance .
Dritan Goxhaj was released from prison by the decision of the Court of Appeal with General Jurisdiction in Tirana on October 10, 2023. This court overturned the decision of the Court of First Instance, rejecting Goxhaj's extradition.
Dritan Goxhaj was arrested on July 31, 2023 with an arrest warrant issued by the Special Court of Kosovo for the purpose of extradition to The Hague. The ex-KLA fighter faced the charge of revealing the names of witnesses in several cases previously opened by the Special Prosecutor's Office of Kosovo, charges which he denied during the trial against him.
