A few days ago, the chairman of the socialist parliamentary group, Taulant Balla, called on the opposition for cooperation in the adoption of a package of changes to some laws that are part of the justice reform package. In the Assembly, three draft laws have been proposed by the opposition for some important changes in the Criminal Code, initiatives which were presented to the Laws Committee on March 27, 2023. The representatives of the majority have expressed in principle in favor of the proposed changes in the Criminal Code, but the chairperson of the Laws Committee Laws, Klotilda Bushka has emphasized that the opinion of the government should be taken and that a working group for the new Penal Code has been set up in the Ministry of Justice.
The draft law proposed by DP deputy, Ina Zhupa, aims to increase the punishment for threats and violence against journalists. The draft law proposed by the Freedom Party provides for the removal of criminal liability for gatherings without a permit. The third initiative, which may bring unpredictable consequences and political storms in Albania, has been proposed by a group of opposition MPs led by Sali Berisha. The draft law provides for the removal of the statute of limitations for criminal prosecution and punishment of corruption, for a group of rulers and former rulers.
The legal initiative adds a sentence to Article 67 of the Criminal Code, with the following content: "The criminal offenses and criminal charges of corruption and organized crime against the Prime Minister, Deputy Prime Minister, Minister, Speaker of the Assembly, Mayor of Tirana are not subject to the statute of limitations. , the heads of central institutions responsible for public procurement and concessions, as well as the aforementioned former officials. This provision extends its effects until 31.12.2037".
Including former officials, the proposal attacks Sali Berisha's ally, Ilir Meta, four times, since Meta has held the post of prime minister, deputy prime minister, minister, and speaker of the Assembly. The proposed change in the Penal Code, if approved by the Assembly, enables the opening of the corruption files alleged by Sali Berisha, even during the Meta government, in the period 2000 to 2002. Berisha's strong and serious denunciations of the alleged corruption especially during Meta governance, would be an indication for SPAK to open the files.
