
Lawyer Arben Llangozi has called the situation created in the judicial administration extremely problematic due to the pronounced lack of judges both in the court of Special Appeal and in the Administrative Appeal.
In a television interview, Llangozi stated that in the Administrative Appeal there is a selection of files with preference, saying that this action not only contradicts the law, but leaves other cases unjudged. The lawyer emphasized that there is a malfunction of almost the entire judicial system in all of Albania.
According to him, civil cases are dragging on for a period of seven years and are not judged and this is due to the small number of judges. Llangozi emphasizes that if the number of judges in the Appeal is not met, the situation will worsen.
" We have a shortage of judges and a case that we tried for about a month, and when a month passed more than the deadline, it was considered a serious violation, and KLD even took measures.
Currently, in the Court of Tirana, a case is judged once every seven months or a year. This is not due to the fault of the judges, but due to the selection and lack of judges. But even the facts that have been taken with their vetting, has led to procrastination. We have a lot of violations due to the fact that there are no judges. In the Court of General Jurisdiction of Appeal there are 25 judges out of 78 that should be in total. Not that there are no judges for replacement, but that they are reserved for vetting members, who should be treated with status as Appellate judges, this is the reason why the Court of Appeals has not been completed.
They ask the KLJ to have the status of an Appeal judge. If the members of the vetting come and do the work of the Appellate judge, this not only constitutes a violation of the citizens waiting in line to be judged, but they cannot get the status of the Appellate judge, since none of the members of the vetting have finished school. of the Magistrate.
The judges who are in the Appeal, in my opinion is correct, the problem is their number. Civil cases are dragging on for a period of seven years and are not tried and this is due to the small number of judges.
The appeal is being held in order for these members to come. The biggest delays are in civil files because the court has given more priority to criminal files. What are security measures, replacement of security measures, revocation of measures and removal of security measures, have not been judged by internal order.
A very dangerous practice has been created by the court. In other courts, little by little, the created vacuum is being filled, but the General Jurisdiction Court of Appeal remains problematic. The key to functioning should be the Court of Appeals, complete with judges. There are many qualified and professional judges who can fill the positions, but the vacancies are not opening. This problem can be solved only after two or three years, when the justice reform is completed" , said Llangozi for MCNTv.
