
The Court of Tirana has declared incompetence for the January 21 file and has passed the file to SPAK.
A few days ago SPAK registered the file, where 4 protesters were killed on Dëshmorët e Kombit boulevard, while it has started investigations to clarify the event.
"January 21" will be investigated by SPAK, which is obliged to record the criminal proceedings and reveal the responsibilities of Sali Berisha, Lulzim Basha, Ndrea Prendi and others for the murder of 4 innocent people on the boulevard. This is the order of the Supreme Court, which accepted the request of Aleks Nika's family members, so that the state crime of 13 years ago can be fully revealed.
We remind you that this week Rajmonda Nika, the wife of Aleks Nika, one of the 4 protesters killed in the January 21 protest, appeared at SPAK.
She was accompanied by the uncle of the deceased, Mark Nika, where both testified at SPAK regarding the file of January 21.
Rajmonda Nika was the one who won the battle in Strasbourg where the International Court considered it as state murder and expressed the lack of investigations in Albania during these years.
It was the Supreme Court that ordered the Special Prosecutor's Office to record the proceedings, following the decision of the European Court of Human Rights.
On July 16, the Special Prosecutor's Office registered the criminal proceedings for the file of January 21, for the murder of Aleks Nika and the wounding of three other protesters, Artes Dybeli, Ilia Qesko and Ilia Papa.
Through an announcement, SPAK says that it has registered the criminal proceedings for "murder in other qualifying circumstances" carried out in cooperation, "abuse of duty" and "Performing actions that prevent the discovery of the truth".
SPAK says that it has decided "Determining the subject competence for the investigation of criminal proceedings no. 285, of 2011, registered in the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, appointing the Special Prosecutor's Office against Corruption as the competent prosecutor and Organized Crime."
The murders of Aleks Nika and Hekuran Deda and the gunshot wounding of 6 other people, during the Socialist Party's protest in front of the prime minister, remained without perpetrators and the prosecution suspended it for years in search of evidence.
Also, the prosecution said that it had also taken into account the decision of the European Court of Human Rights of November of last year, which requested clarification of the incident and found the Albanian state guilty of violating the right to life and the right to investigation. .
The European Court of Human Rights in its decision asks Albania to "identify and punish those responsible for the murder of the applicant's relative during the 2011 protest in front of the Prime Minister's Office". The ECtHR also found that the investigations were obstructed by the government of the time and specifically the former prime minister Sali Berisha and requested that the investigations of the incident should include the chain of command of the Republic Guard and not only the officers who opened fire.
