GJKKO has released the former deputy of SP, Jurgis Çyrbja, who was arrested by order of SPAK. The same measure has been decided for Arben Masha.
The session at the Special Court started today at 8:00 a.m. but was interrupted at the request of the lawyers to familiarize themselves with the file and resumed at 10:00 a.m.
Jurgis Cyrçbja was arrested by order of SPAK, as he is charged with three charges. SPAK says in the announcement that unidentified officials sold state secrets in 7 cases. According to the Special Prosecutor's Office, Çyrbja intervened in law enforcement agencies to buy votes in 2021.
"The applicant, the Special Prosecutor's Office against Corruption and Organized Crime, on 21.10.2024, submitted to the Court the request with the object: "1. Verification of the conditions of implementation of the insurance measure and the needs of the personal insurance established for the persons under investigation Jurgis Çyrbja and Ahmet Masha with decision No. 126, dated 20.10.2024, of the First Instance Court for Corruption and Organized Crime. Criminal Procedure, for the persons under investigation Jurgis Çyrbja and
Ahmet Masha".
2. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Erjon Bani, based on articles 103, 112, 248 and 260 of the Criminal Code, with decision No. 129, dated 22.10.2024, decided:
1. Continuation of the security measure "Arrest in prison" provided by article 238 of the Code of Criminal Procedure assigned to the person under investigation Jurgis Çyrbja by decision No. 126 Act, dated 20.10.2024 of the Special Court of First Instance for Corruption and Organized Crime, as a suspect for committing the criminal offense "Telling state secrets by citizens", committed more than once (according to the respective episodes) , provided by article 295/1 of the Criminal Code, "Supporting the author of the crime", committed more than once (according to the respective episodes), provided by article 302/1/2 of the Criminal Code, "Disclosure of state secrets by citizens ", carried out in cooperation with the investigator Ahmet Masha, provided by articles 295/1 and 25 of the Criminal Code, "Supporting the author of the crime", carried out in cooperation with the investigator Ahmet Masha, provided by articles 302/1 and 25 of the Code Criminal, as well as "Active corruption in elections", provided by article 328 of the Criminal Code.
2. Continuation of the security measure "Arrest in prison" provided by article 238 of the Code of Criminal Procedure assigned to the person under investigation Ahmet Masha by decision No. 126 Act, dated 20.10.2024 of the Special Court of First Instance for Corruption and Organized Crime, as a suspect for committing the criminal offense "Telling state secrets by citizens", carried out in cooperation with the person under investigation Jurgis Çyrbja, provided for from articles 295/1 and 25 of the Criminal Code and "Supporting the author of the crime", carried out in cooperation with the person under investigation Jurgis Çyrbja, provided for by articles 302/1 and 25 of the Criminal Code. 3. The Special Prosecutor's Office against Corruption and Organized Crime is charged in cooperation with the judicial police for the execution of this decision.
4. Based on Article 103 of the Penal Code, the publication of the descriptive and reasoning part of this decision, the request of the Special Prosecution against Corruption and Organized Crime for the appointment of personal security measures, as well as the acts related to this, is prohibited case through the press or mass information until the completion of preliminary investigations. Failure to comply with the obligations set forth in Article 103 of the Code of Criminal Procedure constitutes a criminal offense under Article 295/a paragraph 3 of the Criminal Code under the heading "Disclosure of secret acts or data".
5. Against this decision, an appeal can be made to the Special Court of Appeal for Corruption and Organized Crime within 5 (five) days, starting from the day after the announcement of this decision" , the Special Court announces.
