Jamarbër Malltezi, the son-in-law of former Prime Minister Sali Berisha and Xhimi Begeja, turn out to have been the shadow owners with 60 percent of the shares in the "Homeplan" construction company, which erected 17 residential towers on the grounds of the former "Partizani" complex.
In the material provided by "Ora News", it is clear that the two people had made a verbal agreement with the businessman Fatmir Bektashi, and that they received the financial benefits from "Homeplan" through the calculation of the dividend. Euros or leks were received in cash and through bank transactions.
Such a fact has been admitted by the interrogated Fatmir Bektashi himself, who, during the questioning at the prosecutor's office, has shown that:
"...I stand by my statements that the company "Homeplan" was created from the beginning with a verbal agreement with citizens Jamarbër Malltezi and Xhimi Begeja, where these people would be investors in the form of influencing other owners to sign investment contracts with "Homeplan". But only in 2014, as I see from the document, it was legally formalized...".
In the testimony he gave in SPAK, it is shown that his role in the compilation of the company's documents was almost in the shadows, since according to him all the documents were made by Andia Pustina, Jamarbër Malltez's confidante.
"... all the acts related to the activity of the company "Homeplan" from the financial and legal side were prepared by citizens Andia Pustina and Laura Pustina and I only signed them. I want to clarify that the company "Homeplan" has never had a cash register and everything, every financial action was carried out through bank accounts. Dividend withdrawal is also carried out in the same way. Even in relation to the decision-making of the company "Homeplan" I do not have any role, that is, to express an opinion about the company's decisions. So I did not participate in the decision-making process, but I only signed those compiled by Andia Pustina. For the signing of every act related to the "Homeplan" company, I go to Andia Pustin's office, which is located in front of the University book, and sign them there. Andia called me to come and sign..." - stated Fatmir Bektashi.
Furthermore, the businessman Bektashi has shown that:
"...when privatization was achieved and the lands were returned, did the company "Homeplan" establish itself as an investment company in order to separate the investor from the builder. Where the builder would be the company "Kontakt". In the "Homeplan" company, I was in the minority as I only had 40 percent of the quotas, while Jamarbër Malltezin and Djind Begene have another part of 60 percent of the quotas. To my knowledge, the actions for the registration of the "Homeplane" company were performed by the notary Laura Pustina. Jamarber Malltezi and Xhimi Begeja undertook to convince the land owners to sign the agreement with the owners of the construction company. They both did this from the beginning, when I took it upon myself to pay the amount needed for the privatization of the "Partizani" football club facilities. I don't remember when the agreement was signed with the owner families, who made the land available for construction. Jamarbëri Malltezi and Xhimi Begeja did not contribute any money to the "Homeplan" company, but their only contribution was to convince the other co-owners to make an agreement to make the land available for construction. Also, Jamarbëri and Xhimi agreed to sell the objects we were going to build at a low price...".
Fatmir Bektashi, in his testimony given at SPAK, has shown that:
"...conceptually, Jamarbër Malltezi and Xhimi Begeja have always been part of the "Homeplan" society, regardless of when things were reflected in the National Registration Center. We had verbal agreements with Janarber Malltez and Bege, where I only had 40 percent of this company. I have told these two people, Jamarbër and Djimit, with a verbal agreement to appoint their own representative for the finances of the "Homeplan" company. And they had Andia Pustina as an economist, that is, their representative to keep the balances of "Homeplan". As for myself, I had a financial employee. Legally, I took every financial document to Andia. I kept the reports with Andia and took them month by month. Andia put everything in the balance sheets of "Homeplane".
Regarding signing as sole partner in "Homeplan" company, Fatmir Bektashi has affirmed that:
"...every letter from the company "Homeplan" was received by Andia Pustina, who is the sister of the notary Laura Pustina, and I can give a detailed statement only after consulting Andia and the documentation kept by her. I can say that "Homeplan" was created from the beginning with the agreement of Jamarbër Malltez and Djimi Bege, where they would be called investors despite the fact that they did not give them any money, but they had undertaken to convince the owners of the land for it entered into an agreement for construction. Each document was prepared by the notary Laura Pustina, in connection with the company "Homeplan". The investment agreement that I signed with Jamarbër Malltez and Xhimi Begeja was also prepared at this notary. I currently do not hold any documents of the "Hameplan" company, as they are held by Andia Pustina...".
