The lawyer Jordan Daci has commented on the measure decided yesterday by GJKKO 'obligation to appear' for the former prime minister Sali Berisha.
According to the lawyer, Sali Berisha could risk up to 12 years in prison, while Malltezi is in a more difficult position with the charges listed by SPAK.
SPAK said that Jamarbër Malltezi benefited 5.4 million euros from the privatization of the 'Partizanit' complex without investing anything.
"It is not about a real accusation, but about an accusation within the reasonable suspicion that the persons have committed this criminal offense. How much can be tested? This is a challenging question. At this stage, he does not prove the accusations that there is even SPAK. If there are doubts that these acts have occurred, it is enough to have a procedure. The process at this stage does not deal with the proof of the charge. The standard required for SPAK and GJKKO is many times smaller to start the investigation. For its reasons that have been decided, it seems that SPAK has managed to convince the court that there are several reasons here. I only read SPAK's announcement which was careful to give minimal details. The event would not be news at all if it were not for these two characters, for Mr. Berisha and his son-in-law. It is reasonable since it is about a former prime minister. I believe that the procedure used an ambiguity created by Article 289 of the criminal procedure. Does it constitute a restriction in any form, the obligation to appear, including the ban abroad. This limits the freedom of the person," he told News 24.
The Special Prosecutor's Office, SPAK, has officially communicated the charge brought against the former Prime Minister, Sali Berisha, his son-in-law, Jamarbër Malltezi and the builder Fatmir Bekatshi.
In a statement to the media, SPAK lists the evidence it has provided from the investigation started in 2020, when the former General Secretary of the SP, today the Minister of the Interior, Taulant Balla, accused special structures of the privatization of the former "Partizani" complex.
SPAK says that Berisha, in the capacity of the Prime Minister of Albania, has made available to Malltez, various structures of the state administration in order to realize the privatization process of the former "Partizani" complex.
