The mobsters of the "Bankers" company turned to the Court of Arbitration in Paris, with the request that the Albanian government not ask for the 236 million USD, which this company received from the state budget, for the alleged losses suffered during the concessionary oil business. .
"Bankers" lost the trial in arbitration, because the recovery of losses, defined in the concession contract dated June 19, 2004, was illegal favoritism, or rather it was theft in the bargain with the leaders of the Albanian government of that time.
But the Albanian government will not engage the Ministry of Finance, Albpetrol and the Agency of Natural Resources as contracting parties, so that "Bankers" return the theft in the amount of 236 million USD, even after 11 years of SP in power, this company is being allowed to pay neither local taxes nor income tax.
The official documents available to "Pamphlet" prove that it was Prime Minister Sali Berisha, who favored the "Bankers" company, with the removal of taxes and fees, which until the end of 2007, had obligations under the concession contract.
By Decision no. 22, dated December 12, 2007, of the State Aid Committee directed by the Minister of Economy, Genc Ruli and with the approval of Sali Berisha, the company "Bankers" was exempted from the obligation of the 20% VAT tax, and from the customs fees for the export of quantities of oil and imports of raw materials, auxiliary materials, machinery and equipment.
The decision of the end of the year 2007 was with this object: Change of the existing scheme, for the exemption of hydrocarbon operations from customs duties and VAT taxes; based on the proposal of the Directorate of State Aid, in the study of the Directorate of Industrial Policies of the Ministry of Economy-Trade-Energy.
In point 4 of the government's decision, it is stated: Exemption from VAT and customs taxes is done as a convenience for the company "Bankers Petroleum Albania", because until today, it has not managed to cover with its income, the total costs of the activity.
In order to justify this decision, Sali Berisha has officially deceived, saying that during its activity, the "Bankers" company has not discovered new oil reserves and has not had production even in the existing wells, and consequently there has been no sale of oil and gas.
As a basis for the exemption of "Bankers" from customs duties and VAT, Sali Berisha used his decree No. 782, dated February 22, 1994 "On the fiscal system in the sector of hydrocarbons in research and production",
In the decision, it is stated: With the exemption from the 20% VAT tax and the exemption from customs fees, a safe basis is created, so that in 2009, the company "Bankers" will achieve a positive financial result, subject to the obligations for the payment of tax on the profit in measure 50%.
But "Bankers" did not pay even in the years 2009-2013, because the "Berisha" government accepted balances with losses; a decision that was also left in force by the "Rama" government, paying nothing for 17 years, the VAT tax and customs taxes on exports-imports and profit tax, because the Chinese owners are friends of Olsi Rama./ Pamphlet
