The court decision is a serious political setback for Prime Minister Giorgia Meloni, especially since the decision was not a surprise.

The primary goal of Giorgia Meloni's government was for migrants to stay in deportation centers in Albania for a maximum of thirty days and then be deported.

But in reality the time limit has been exceeded: the first group of 12 immigrants left the camp after only four days; The second group of seven refugees, who arrived in Albania last Saturday, will leave on Tuesday. Contrary to the government's intentions, immigrants are not "sent home" but to Italy, where they must be released immediately.

This was ordered by the Rome court, which had already made a decision on the first group of immigrants. In both cases, the asylum seekers came from Egypt and Bangladesh. The Italian judges based their decision on a ruling by the European Court of Justice (ECJ), which ruled on October 4 that countries of origin can only be considered "safe" if they are so throughout their territory.

And this was not the case with Egypt or Bangladesh, the court pointed out. Therefore, the immigrants could not be deported at all, therefore they would have to be transferred to Italy and released. Albania is not prepared to accept asylum seekers from the Italian camps themselves.

The court's decision is a serious political setback for Prime Minister Giorgia Meloni, especially since the decision was not a surprise: ECJ rulings are superior to national law. But the government in Rome wanted to hit the wall with its head, and after the first negative court ruling in October, it hastily passed an emergency law that quickly elevated the existing list of safe countries of origin to the status of a law that the courts could followed.

The government had also appealed the Rome court's decision to the Court of Cassation, Italy's highest court.

The Court of Cassation is expected to rule on the matter in early December. And the ECJ will also deal with the Italian camps in Albania in the next two or three months, because a court in Bologna had forwarded an immigrant's complaint to judges in Luxembourg, shortly after the issuance of the decree on safe places of origin, with a request for clarification of whether European or Italian law should apply to safe country of origin issues.

After the second group of immigrants left again, it is expected that the right-wing government of Giorgia Meloni will no longer insist and send no more immigrants to Albania, until the Court of Cassation and the ECJ of Italy deal with the case.

Initially, there were no political reactions to the decision of the Roman court, which was made only on Monday evening. The first decision in October led to a serious conflict between representatives of the government and the judiciary.

In particular, Deputy Prime Minister and Lega leader Matteo Salvini described Roman judges as "communists" who boycotted the democratic government's decisions in a subversive manner. Roman judge Silvia Albano, who wrote the first ruling in October, then had to be placed under police protection.
