The Constitutional Court of North Macedonia decided to abolish the instrument that had until now balanced the ethnic representation in the state institutions of the country.
Its members voted in secret, say the media in Skopje, as one of the judges, Naser Ajdari, was absent. The claim of the head of the Court, Darko Kostadinovski, is that with what is otherwise known as the "Balancer", the rights and freedoms of citizens were violated in terms of declaration and discrimination was made on the basis of equality because in a competition, as he claims, no all communities were equal to compete.
" It is indisputable that in our constitutional order there is a fundamental value of fair and adequate representation. However, there are others. One of them is the freedom to express ethnic affiliation, such is Article 9, the principle of equality between citizens, such is that everyone has access to any workplace under the same conditions, such is the ban on discrimination on any basis . , was his comment, reports TCh
But precisely the removal of the "balancer" was a condition that the current party in power, VMRO DPMNE, had set in March for Albanian political parties to participate in the new government after the May 8 elections. The motto she used then was "Professional preparation before ethnic affiliation during employment".
The VMRO claimed that as a result of this mechanism, the institutions are "filled with unqualified personnel", since instead of education, ethnicity is taken as the basis, in order to maintain the ethnic balance in the institutions where they are employed. The "Balancer" is part of the constitutional changes approved in 2002 after the armed conflict in 2001 in North Macedonia.
This instrument managed to improve the representation of Albanians in state bodies, who until before its application were very few employed in institutions. The coordinator of the parliamentary group of the VLEN coalition, which is part of the executive, Halil Snopçe, said that despite the decision of the Constitutional Court, they will propose a new law in five or six weeks.
But the European Front reacted harshly saying that the abolition of the balancer is contrary to the Ohrid Agreement and at this point, it is pointless to talk about a new legal proposal for fair and adequate representation when there is nothing concrete. Since VMRO came to power at the end of June, more than 800 Albanians have left their jobs in North Macedonia.
