Antonio Tajani, one of the leading figures of the center-right and Foreign Minister, has commented with irony and skepticism on the decision of the Court of Justice of the European Union, which determines that judges will be the ones to decide on the safety of the countries of return of migrants.
In an interview with Corriere della Sera, Tajani expressed concern that this decision is a step back for legal certainty and that this approach is unsafe, arguing that a judge cannot make decisions on the security of certain countries, as this is a process that requires expertise and cooperation from different institutions. He sees this as an attempt to undermine the role of government institutions and to strengthen the influence of the judiciary in areas that are traditionally under the competence of politics and diplomacy.
"I can say: this almost makes me laugh," says Antonio Tajani, commenting on the decision of the Court of Justice of the European Union, which determines that judges decide on the safety of countries of return of migrants.
Laughing? In the center right, he is the only one who looks at it with this calmness...
"Yes, of course… how can one think that a judge can decide whether a country is safe? Many people work all year round to compile the list of safe countries, analyzing various parameters, in collaboration with embassies and diplomats. It is not an individual decision, nor does a minister decide on his own. It is the result of the work of ministries, the Chigi Palace, the Ministry of the Interior, ambassadors, officials… Now we want to place a judge in the Ministry of Foreign Affairs? Only in judicial dictatorships is everyone open to criticism, except the judges. This is a Jacobin mentality. The judge must apply the law, not choose which destinations are safe. This is not legal certainty, but uncertainty."
If all goes according to plan, the new European Pact on Migration and Asylum will only enter into force next June. Until then, what happens?
"The Chigi Palace has also said it: we intend to move forward. There is also the possibility that the Commission will decide to accelerate its implementation...".
President Mattarella and Prime Minister Meloni have spoken in harsh tones about the situation in Gaza. Will Italy also recognize the Palestinian state?
"Kemi diskutuar edhe ditët e fundit për këtë temë. Njohja është një akt formal me rëndësi, dhe ne jemi në parim dakord. Por sot nuk ekzistojnë kushtet konkrete për një shtet palestinez. Duhet të ndërtojmë së pari kushtet për një shtet që e njeh Izraelin dhe njihet prej tij. Ndërsjelltësia nuk është e dorës së dytë. Gaza dhe Bregu Perëndimor duhet të ribashkohen. Kombet e Bashkuara mund të drejtojnë një mision të paqeruajtësve nën udhëheqje arabe për të garantuar stabilitetin në Rripin e Gazës, dhe Italia është e gatshme të marrë pjesë".
Po tani, një “por”?
«Por nuk mund të njohim diçka që në fakt nuk ekziston. E përsëris: njohja duhet të vijë në fund të një procesi, kur të jenë plotësuar të gjithë “përbërësit” kushtetues të një shteti. Në shtator, në Asamblenë e OKB-së do të diskutohet gjerësisht për këtë, por ndërkohë duhet të arrihet një armëpushim dhe lirimi i pengjeve».
Deri atëherë, ndihmat humanitare vazhdojnë?
"Sigurisht. Dhe jemi në gjendje ta bëjmë këtë vetëm falë marrëdhënieve tona me Izraelin. Të jeni të sigurt: dënimi ynë për atë që po ndodh është i qartë e kanë theksuar edhe Mattarella edhe Meloni. Ajo që po bën qeveria izraelite ka kaluar vijën e kuqe. Për kolonët e dhunshëm duhet të ashpërsohen sanksionet. Është absurde të qëllohet mbi një kishë ose të sulmohen fshatra të krishterë në Bregun Perëndimor. Të krishterët janë një faktor stabiliteti në të gjithë Lindjen e Mesme dhe nuk ndikohen nga Hamas. T’i përndjekësh nuk i shërben as Izraelit, përkundrazi, i jep më shumë fuqi Hamasit".
Presidenti Trump ka lëvizur nëndetëset bërthamore. Duhet të shqetësohemi?
"Është një mesazh politik për një Rusi që reagon gjithmonë në mënyrë agresive sa herë që i kërkohet të angazhohet për paqen. Trump është treguar i gatshëm për dialog, por në këmbim ka marrë deklarata agresive nga Medvedev. Shtetet e Bashkuara janë të hapura për një marrëveshje; Trump ka bërë më shumë se mjaft për të arritur paqen. Por sigurisht, nuk do të lejojnë që Putini t’i mashtrojë".
Megjithatë, tarifat doganore shkaktojnë shqetësim...
"Do të duhet kohë për të kuptuar plotësisht gjithçka. Marrëveshja kornizë do të duhet të zbatohet produkt pas produkti, një punë e detajuar që do të bëhet me SHBA-në dhe Brukselin. Është e vërtetë që 15% është shumë, por është marrëveshja më e mirë e mundshme. Shikoni edhe tarifat doganore diku tjetër: në Indi janë 25%, gjë që krijon edhe mundësi për ne. Unë jam ende i bindur se Banka Qendrore Evropiane duhet të ulë më tej koston e parasë, të zbatojë politika lehtësuese monetare dhe të injektojë para në treg. Raporti euro/dollar është krejtësisht në disfavorin tonë, me dollarin që është zhvlerësuar me 13% që nga fillimi i vitit".
Dhe si mund të veprohet?
"If the euro depreciates, it is better. Moreover, some instruments need to be updated. For example, the "SME supporting factor" mechanism included in the Basel Accords could be revised, by a joint European decision. The limit for loans to small enterprises is currently 2.5 million euros; I think it could be raised to 5 million. However, the EU internal market is our greatest asset. But to increase purchasing power, fiscal pressure must be reduced. And I am in Reggio Calabria today for the three-day meeting of Forza Italia, from which our proposals for the government for the South of the country will emerge."
Roberto Occhiuto, the president of the Calabria region and FI representative, resigned unexpectedly. Do you support this decision?
"It was an act of courage that allowed him to restart the administration's engines. The pace of justice is not that of politics: when an investigation starts, everyone stops, they are afraid to sign. This is also happening in Milan: cities and regions are being blocked. I am a guarantor to Occhiuto, but also to Sala and Ricci: justice must do its job, but we cannot accept the paralysis of the administration."
When will the round table for candidacies in the regional elections meet?
"A date has not yet been set: tomorrow we will be together in Ancona with Giorgia Meloni and Matteo Salvini, and perhaps there we will decide when to meet. Keep in mind that we do not have the problems of the left: ours is a structured political alliance and not simply electoral, such since 1994.
