Meloni is ignoring the law on centers in Albania, but risks suffering it again...

Prime Minister Giorgia Meloni's obstinacy on the issue of the two centers in Albania for holding immigrants seeking asylum is an excellent metaphor for a woman who is getting a little carried away and who thinks she is above everything, even above the law but also above reality.

In the last meeting of the government, which created the impression that it was very formal and with predetermined results, Meloni again claimed the usefulness of the famous centers in Albania for the transport or deportation of immigrants detained in Italy.

A strategy that, after the negative decision of the Court of Rome, left the worst impression on the Italian Prime Minister. Now, says the government, we will start working again, as if nothing had happened. She even promised "innovative solutions" but without giving details and without explaining why the operation should start working suddenly.

Among other things, Georgia Meloni emphasized the "broad consensus that was seen, also on the occasion of the meeting promoted together with the prime ministers of Denmark and the Netherlands with the member countries most interested in this issue, within the last summit of European Council".

But on the other hand, it avoided the problem in the background, which is related to the judges' decision in evaluating the concept of a "safe place". The secretary of the "Più Europa" party, Riccardo Magi, explained this approach better.

"According to this logic, the government can declare that Egypt is also a safe country, because when Matteo Salvini was there on vacation, nothing happened to him. However, the courts still have the power, but also the obligation, to assess whether a country is really safe for any migrant arriving in Italy to seek asylum, and whether the accelerated procedure can be applied with their detention in the two centers set up in Albania" he said.

This was and remains the weak point of Georgia Meloni's approach. She feels stronger after a Supreme Court decision, which also confirmed the possibility for judges to generally assess the safety of an immigrant's country of origin, and not apply the government's decree on the list of countries deemed safe.

Therefore, the fact that the Italian government drafts its list of safe places by decree, if these do not comply with the parameters determined by jurisprudence and European regulations, is of no great value. Because since it is a provision of national law, the decree must also be in line with European legislation.

The government's other plan, which is legally weak, concerns the transfer of decisions from the courts of first instance to those of Appeal, in the hope of obtaining favorable decisions. This measure enters into force 30 days after the entry into force of the law, i.e. on January 11 of the next year, so only from that moment the ship "Libra" will be able to return to work to transport or deport immigrants to the Albanian port of Shengjin.

Apparently Prime Minister Meloni has decided to mess with the law until she wins. It is her typical way of doing politics: not to listen, not to mediate, not to square the differences. But only by shouting from the party stage that the centers in Albania "work!". Prime Minister Meloni is now in danger of sliding dangerously towards a delirium of omnipotence, confusing the practice of a power experienced as absolute, with the coincidence between will and power. Wherever he is, in Atreju or in Lapland, Meloni is showing that he can always move forward.

This will also be valid for the allies of the governing majority. But then there are the judges and Europe. Here lies the problem: since the basic conditions that caused the failure of the first mission with the centers in Albania have not changed, Giorgia Meloni risks failing again.
