The Speaker of the Assembly of Albania, Lindita Nikolla, who of course does not represent only her opinion, is legitimizing as regular the absence of Sali Berisha for six months in the Assembly, as absence with reason. She is quoted as saying: "I want to put an end to the speculation. The presence of a person under this measure cannot be considered as absent without reason in the Assembly. We have consulted with experts in the law and the Constitution".
More than a constitutional debate, this is a political debate and political tolerance. And for this, the socialists may have their own cynical reasons for using Berisha as a political collateral in front of them, but this is neither constitutional nor political nor logical.
First, "absence with reason", as they like to call Berisha's six-month absence, means an obstacle within the legality of the individual's actions, that is, it means a hospital, it means an illness, it means a pandemic, he is stuck somewhere abroad...etc. These are absences with reason. Absence with the reason that "he is in prison a little", only the Albanian socialists can invent for their opponent whom they want dead but not buried. He who is in prison does not have a reason to be absent, but he has a reason to be issued by the Assembly.
Secondly, the mandate of Sali Berisha had to be removed before six months, as it contradicts the decriminalization law, as he has been refused entry to two of the largest western countries, the USA and Great Britain.
In article 2 of this law, which describes the prohibition to run in point 2 paragraph b, it is clearly stated that the prohibition of the functions of a politician is applied when "they are expelled from the territory of a member state of the EU, USA, Australia, Canada in connection with the cases provided by point 1, letter a, b, and c of this article.
We remind you that Sali Berisha is the only "non grata" person, even in two large western states, who enjoys the mandate of deputy. Others are either in prison or out of politics.
Thirdly, the Assembly has revoked the mandate of Arben Ahmetaj, who was also under investigation by SPAKU and wanted by justice. If Ahmetaj had not escaped, but stayed here, he would be in prison like Berisha.
But for our justice, formally he is an escaped prisoner. With this logic, it follows that he was absent for the reason that he is in prison. Berisha is also currently in prison. One's mandate has been revoked, the other is not being revoked.

All this is ugly and of course it is a political account that keeps a dead body in play as it is easier for them to televise the opposition. It is neither legal nor constitutional nor moral. It is only political. And ugly.
