Law itself, is a system of social rules and norms that people must follow in a social grouping. Laws are established and implemented by the relevant institutions and legal bodies of society.
The law is an agreement defined in a few words by a "community of people". All participants who indirectly took part in its formulation are subject to the law. In the democratic world, mainly the Western one, the law has a special meaning, as it is considered as a "rule of conduct that is accepted and applied by all". The law itself is an institution, and its change can be done over time only by specialists in the legal field. But what happened in Albania, how was the experience before 1992, after 1992, and onward? In our country, the law has been part of the changes, as many times as there have been political fluctuations.
It was used as a means of denial, opposition, and pressure when one or several political opponents had to be penalized. The law was "opened and closed" depending on the time conditions. In the totalitarian system, the law was completely at the service of the ruling nomenclature. And the Criminal Code and the Constitution of Albania were drawn up on a strong political basis, creating a strong legal basis for the functioning of the state of that time, where human rights and freedoms hardly had 2-3 separate chapters. The year 1992 found Albania with a new political system.
The Constitution and the Criminal Code of that time were thrown away, and the "creation of new democratic laws" was widely advocated. Various penal codes were copied, from the German, French, Italian, American, English, and Swedish, but never succeeded in creating a body of laws not controlled by politics. It was precisely politics that controlled and changed in detail the laws, the justice system, gave orders and orders for arrests, releases, punishments, nationalizations, executions, all "based on laws".
The law was like a "garter belt". It always opened and closed when talking about politics. The darkest period of post-communist Albania was that of 1992-1997. The Democratic Party ruled, and the law had no legal, but political value. The political opponent was punished, whoever insulted the president, the prime minister, the minister, the head of the party-state was punished, you were punished when you published an article in the newspaper denouncing government theft, crime, trafficking, corruption, newspaper headquarters and party headquarters were closed.
Justice was captured by politics, which invented "Poplars" to train and produce "prosecutors and judges of democracy". The law was profaned, and judicial decisions were taken from the headquarters of the party-state. The situation in the field of law enforcement in Albania was under the constant attention of the Council of Europe, OSCE, EU and DASH. The alarm still fell on the deaf ears of the former head of government and the former president of that time. The change in mentality had to start from the radical reform in the justice system.
Over 417 "Plepash" prosecutors and judges had to be removed from the justice system, as they were guilty of over 48,000 unfair and illegal decisions taken over the years against citizens. The cost was unimaginable.
Former owners were harmed, public assets were sold and bought, millions of dollars were sold and pocketed from the properties of the army, railways, seaports, mines, oil, gas, etc., etc., with illegal decisions of our courts. political. But, "the rubber band was breaking".. Edi Rama came to power with such justice, with such unenforceable laws, but with the decision to change everything. You could not take the right step towards progress and integration, when in front of you lay the stinking "swamp and swamp" that the law had made dirty over time. And has anything been achieved? Yes, much has been achieved. Suffice it to say that the "unpunished", pirates and barbarians of the transition are being investigated and punished.
