The battle between SPAK and Prime Minister Edi Rama seems to be entering a furious fight after the Constitutional Court's decision to suspend until trial the measure requested by SPAK for Deputy Prime Minister Belinda Balluku. After its first day of work, SPAK has asked the Assembly for authorization to submit the request for arrest in prison for Belinda Balluku to the GJKKO, while the Constitutional Court has set January 22, 2026 as the date for the review of the first measure requested by SPAK.

The battle is turning into an angry and pointless brawl, as the government has not rejected the measure issued by SPAK in the Balluku case. The government has suspended Ms. Balluku and has asked the Constitutional Court to interpret whether SPAK has the right to suspend a deputy prime minister or not. The request is not about Ms. Balluku, but about the principle of whether SPAK can have a red line to intervene at this point or not. And the Court stated that, until it judges the request, which is essentially not about Balluku's problems with justice, but about SPAK's problems with political power, it has lifted the suspension.

After this, it would be normal for everyone to wait until January 22nd to first receive the Constitutional Court's decision to continue the political fight.

Today's act by SPAK shows that they stand by the idea that they should be in a political battle with the government and are not at all bothered by the process in the Constitutional Court.

Let's assume for a moment that the Constitutional Court rules in favor of SPAK on January 22. Then which measure stands for Balluk, the one they are demanding today, or the one they were demanding a few weeks ago?

This legal mishmash, just to show who is stronger, is turning SPAK's battle with political power into a gladiatorial battle, which is losing the standards that should be established and that in a way have been established before with the judgment of high officials.

It would be normal to wait until January 22nd, and if SPAK won that battle, there would be no need for this measure proposed today. If it lost, of course it could try this measure too, or a more severe or milder one, but there might not be a need, since Mrs. Balluku could then resign.

So there was no need for all this spectacle anymore.

That this is not just a battle with the government, but also with the country's courts, and in this specific case with the Constitutional Court, which they cannot command like the GJKKO, which they have under surveillance 24 hours a day without authorization.

So SPAK has reacted as an actor dissatisfied with the Constitutional Court and has increased the security measure as a reaction against the Constitutional Court. This is no longer a procedure, but a battle with the courts that SPAK does not have under its control.

All this leaves the taste of a bitter battle, which can only be avoided by respecting the procedures that SPAK itself has initiated and that have been appealed to the Constitutional Court. Let them finish the job once and for all on January 22, then if SPAK wins, there is no need for new measures, and if the government wins, of course there will be political developments to pave the way for justice. But not bitter clashes.
