The sadistic prosecutor as the theorist of democracy!

It seems as if prison, solitude, deprivation of freedom, the cell, the open space, even makes the prosecutor a communist, a savage sadist, a philosopher of democracy!

Years ago, I came across a book written by Bedri Spahiu in which he makes a kind of apology for the sentences he handed down as a prosecutor in the first years after the country's liberation from the Nazis, that is, in the second half of the '40s.

His story is known. Partisan, communist orator, and after the liberation of the country in very high positions in the party and in power until in the mid-1950s he too ended up in prison and in exile until the fall of communism.

He then published a book summarizing a kind of diary of his ordeal, reflections, memories, letters he sent from prison to the prime minister of the time, Mehmet Shehu, etc.

At one point, Bedri Spahiu stops at the status of prisoners in the dictatorial regime. He more or less says that as long as a prisoner will not have rights there in the dungeon, no one outside the prison is sure that one day they will not be thrown inside too. He based this on the fact that prisoners without rights were given false statements against those outside the prison, and were used in the struggle for power!

Bedriu seemed to be reminded of what would happen to Mehmet 25 years later. Depositions that God knows how were taken and buried this second one too.

That is why I call the book by Bedri Spahiu, a criminal prosecutor, the best book in Albanian in political science. There he puts forward the strong idea that the fate of those outside prison is in the hands of those in the cell. He implies that the fate of democracy is decided in prison. That is where the implementation of human rights begins.

It seems as if prison, solitude, deprivation of freedom, the cell, the open space, even makes the prosecutor a communist, a savage sadist, a philosopher of democracy!

We also recognize the transformation of the persecutor into a martyr in the case of Saint Paul!

But, not only!

This should never be forgotten. The prisoner may be accused of murder, theft, conspiracy against the state, theft, slander, accidents with serious consequences, abuse of power, treason, abuse of tenders, corruption, violation of equality in tenders, whatever, in any case he should have rights up to one.

Let's understand each other, not only about what the cell is, but also about those outside the barbed wire!

Even when he has been found guilty by a court decision, even when he is accused and is being investigated while at large.

Above all, whatever his name is, whatever position he has held, president, minister, prime minister, mayor, or whether he was a bricklayer, businessman, athlete, writer, it doesn't matter, he is generally investigated in a free state until the court decides on his or her guilt or innocence.

This means that anyone who is proven guilty must repay society, according to the law, for the great harm they have caused.

But after being found guilty. There is no reason to be afraid of destroying evidence. Documents are seized. The complicit collaborators are brought before the laws, as obstruction of justice is the greatest crime. Above all, as happens in Europe, there is no reason for someone's criminal acts to be collected to be punished once and for all. Anyone who has committed a crime is punished for those crimes that are proven. If there are others later, there are trials again.

But, I don't think anyone, whether a tender thief or a pickpocket, can be held for months or years in detention, which is a prison, because they are being investigated!

This is because for decades, I have been reminded of the letter from the criminal prosecutor under the dictatorship to the dictatorial prime minister that your peace starts with me here in the cell.

That democracy begins in prison!

Yes you wanted: In detention!

Without rights, each of us innocent people is guilty, let alone those in detention!
