The Special Prosecution Office is reviewing the requests of the General Directorate of Prisons to place five prisoners in the harsh 41-biss regime. Their identities are not being made public.
The SPAK annual report shows that these prisoners remain under constant monitoring. Authorities monitor their communications and meetings to assess whether there is evidence that justifies their isolation in this regime.
If SPAK finds sufficient evidence, the final decision to switch to 41-biss is approved by the Minister of Justice, Toni Gogu. This regime is based on the Italian model used against mafia structures.
According to official data, over the past year, the Prison Directorate has submitted nine requests for this measure to SPAK. These requests are based on suspicions that some convicts continue to maintain suspicious contacts with people linked to crime even while serving their sentences.
After verifications and interceptions, SPAK decided not to initiate proceedings in four of the cases, as it did not identify sufficient evidence to move to the full isolation regime.
Meanwhile, of the two structures created for the 41-biss regime, one is adapted to keep fugitives from justice separate from the rest of the prisoners. The other structure, located in the high-security prison in Peqin, currently does not have any prisoners placed under this regime.
The evaluation process for the remaining five requests continues under the supervision of SPAK. The final decision will be made after analyzing all the evidence and indications collected.
