The uncle of Aleks Nika, one of the victims of "January 21", spoke about the decision given by the Strasbourg Court today.
He said that the victims of "January 21" were murders that were ordered by the state. According to Aleks Nika's uncle, politicians were implicated in those murders and that "the leaders of the opposition today are participants".
He said that the perpetrators should go to justice, while the decision given today by the Court has been awaited for a long time.
Among other things, he said that new evidence has emerged in relation to the incident.
Today the court came to the conclusion that there are two violations in this case: murder and then not solving the crime. Likewise, in the argued decision of Strasbourg, it is stated that there was a violation of the procedural obligation and the essential part of Article 2 of the Convention, a violation of two aspects of the right to life.
The Human Rights Court clarifies that the authorities have failed to conduct an effective investigation and that during the political protest, according to it, lethal force was unjustifiably used.
Today, the Strasbourg Court came to the conclusion that there are two violations in the murder of Aleks Nika: the murder and then the failure to solve the crime. Likewise, in the argued decision of Strasbourg, it is stated that there was a violation of the procedural obligation and the essential part of Article 2 of the Convention, a violation of two aspects of the right to life.
The Human Rights Court clarifies that the authorities have failed to conduct an effective investigation and that during the political protest, according to it, lethal force was unjustifiably used. Among other things, the Court underlines the fact that as there were specific deficiencies in the investigation of the case in question, it is called to identify and punish those responsible for the crime. Strasburg also emphasizes that there were defects in the exercise of duty by the police for the smooth running and control of the protest.
The court emphasizes, among other things, that compensation is one of the measures that the state must undertake for the victim's family. "The evidence showed that the Garda fired at the protesters. The shooting was caught on camera and broadcast. The government accepted the disproportionate violence of the Guard", the decision of Strasbourg states.
Aleks Nika was killed in the protest of January 21, 2011 on the "Dëshmorët e Kombit" boulevard, along with 3 other protesters. After the long judicial ordeal, Nika's family sent a lawsuit to the European Court of Human Rights.
We recall that on January 21, 2011, the socialist opposition called the citizens to a protest, after the Meta-Prifti video scandal, where there was talk of a corrupt affair. After the clash with the police and attempts to enter the Prime Minister, 4 protesters were killed.
Hekuran Deda, Ziver Veiz, Faik Myrtaj and Aleks Nikaj lost their lives in the protest. So, the first investigation brought Ndrea Prendin and Agim Llupon as defendants for the incident. On the other hand, the court assessed that the murders of Ziver Veiz, Faik Myrtaj and Hekuran Dedaj happened due to carelessness and sentenced the former commander of the Guard, Ndrea Prendi to one year in prison, as well as the guard Agim Llupo to 3 years.
