The Strasbourg Court overturns the decision against Arben Frroku, sentenced to life imprisonment for the murder of Commissioner Dritan Lamaja!
The Court of Human Rights assesses that the judicial process against Arben Frroku contains violations of his rights, and as such he should be retried at least by the Constitutional Court of Albania.
Mr. Frroku's defense, attorney Tonin Prendi, appealed to Strasbourg for several violations of the Frroku case, and on January 14 of this year, the court issued its verdict.
The unanimous Strasbourg decision obliges the Albanian state to reopen the case in this court, giving Frroku the opportunity for a new hearing. Also unanimously, Strasbourg has rejected Frroku's request for damages of 50 thousand euros and compensation for expenses of 10 thousand euros.
The man convicted of the murder of Commissioner Dritan Lamaj was arrested under a false identity by Dutch police in 2016, where he is currently being held.
Arben Frroku has been convicted of the murder of Commissioner Dritan Lamaj on February 24, 2013. Businessman Frroku, once the former chairman of a political party that was later led by his brother, Mark Frroku, denied the crime during the trial, using his trip to Greece as an alibi. His lawyer claimed that Frroku was near Elbasan at the time of the murder.
However, the Prosecution gave a different version to the Serious Crimes Court. Through a police experiment, the investigative team claimed that there was enough time for Frroku to commit the murder and arrive at the border crossing at the moment shown by the cameras.
On the other hand, the Prosecution secured the testimony of a person who later obtained protection status. The eyewitness with the code name Arben Ndoka claimed in court that he had seen Frroku without a mask in the car from which Lamaj was shot.
The two claims clashed in the Court of First Instance, where Arben Frroku emerged victorious. He was found not guilty on April 3, 2015. He was convicted in the Court of Appeal on June 29, 2015, a few days after he had left Albania.
His brother, Mark Frroku, managed to become an MP in the 2013 elections, as the leader of the Christian Democratic Party, an ally of the ruling coalition led by the Socialist Party. He resigned as an MP after being arrested, wanted by Belgian justice for murder.
