The decision comes at a time when almost every segment of the administration is forced, willingly or unwillingly, to share or re-share, 'like' or comment on the political activities of MPs, ministers, the Prime Minister or any other official campaigning in favor of the Socialist Party.
The involvement of the administration in elections remains one of the stains on the electoral processes in Albania. And for this, the reports of international organizations after each electoral process, which highlight the use of the administration in favor of the ruling party, are sufficient.
While the campaign for the May 11 elections has not yet officially begun, the opposition and members of civil society have denounced cases where administration employees have been asked to fill out forms with the names of their relatives living abroad. This is in the context of votes from the Diaspora, which for the May 11 elections will exercise the right to vote by mail for the first time.
But how will administration employees be monitored before and during the campaign, and will they have the right to publicly express their preferences for candidates or parties?
A government decision, published in the official gazette, defines the categories that are not allowed to support the campaign of a party, a member of a political party or an independent candidate, by participating or contributing physically or financially.
On the other hand, the employee of the state administration, after official working hours and outside the premises of state institutions, has the right to participate in political or electoral activities of a political party or candidate in the elections, but without publicly expressing his political beliefs or preferences.
The decision comes at a time when almost every segment of the administration is forced, willingly or unwillingly, to share or re-share, 'like' or comment on the political activities of MPs, ministers, the Prime Minister or any other official campaigning in favor of the Socialist Party.
The decision states that the civil servant, while participating in the activity, within the meaning of Article 37 of Law No. 152/2013, “On the Civil Servant”, as amended, is prohibited from:
a) to campaign for an electoral entity or candidate;
b) to demonstrate with banners, slogans or any other written and publicly displayed means;
c) be a protagonist in political or candidate activities/activities.
Who is prohibited by decision from supporting the campaigns of parties or candidates?
The three categories that are prohibited from supporting the campaigns of political parties or candidates in elections are employees of the State Police, the Republican Guard, and those of the SHISH. They are also prohibited from
State Police employees are prohibited from supporting the campaign of a party, political organization, a member of a political party or an independent candidate, by participating or contributing physically or financially.
Employees of the Guard of the Republic are prohibited from: a) behaving and holding positions that violate the depoliticized nature of the Guard;
b) anëtarësimi e pjesëmarrja në veprimtari të partive a të shoqatave politike apo të kandidatëve.
Punonjësit të Shërbimit Informativ të Shtetit i ndalohet: a) të manifestojë sjellje dhe të mbajë qëndrime, që cënojnë natyrën e depolitizuar të institucionit;
b) anëtarësimi dhe pjesëmarrja në veprimtaritë e partive apo të shoqatave politike, apo të kandidatëve;
c) të bëjë propagandë në favor ose kundër partive, shoqatave politike ose kundër kandidatëve në zgjedhje.
Ushtarakut aktiv të Forcave të Armatosura i ndalohet të marrë pjesë në veprimtaritë politike që organizohen nga partitë politike, organizatat ose shoqatat me karakter politik apo nga kandidatët.
Po kështu punonjësit të administratës shtetërore i ndalohet të përdorë të mirat publike, funksionin ose veprimtarinë shtetërore, ose burimet financiare a njerëzore, me qëllim favorizimin e një partie politike ose kandidati në zgjedhje.
Kontrolli
Titullarët e ministrive dhe/ose drejtuesit e institucioneve të varësisë ose personat e ngarkuar prej tyre:
a) organizojnë menjëherë punën dhe marrin masat e nevojshme për garantimin e zbatimit të detyrimeve ligjore për ndalimin e vënies në përdorim për subjektet zgjedhore të veprimtarisë së tyre institucionale, mjeteve, fondeve e materialeve të ndryshme, pronë e administratës shtetërore, si dhe të burimeve njerëzore të institucioneve të administratës shtetërore, të çdo niveli, përzgjedhjet e përgjithshme të datës 11 maj 2025;
b) kontrollojnë në mënyrë periodike veprimtarinë e nëpunësve nën varësinë e tyre, me qëllim shmangien dhe parandalimin e nxitjes apo kërkesës për përfshirjen e punonjësve të administratës shtetërore në veprimtari politike apo në mbështetje të një partie politike ose kandidati në zgjedhje;
c) verifikojnë dhe analizojnë të gjitha të dhënat që kanë të bëjnë me përdorimin e mjeteve, fondeve e materialeve të ndryshme, si dhe mënyrën e ushtrimit të veprimtarisë institucionale, gjatë periudhës përpara fillimit dhe gjatë fushatës zgjedhore, në funksion të evidentimit të përdorimitose jo të tyre për qëllime elektorale;
ç) marrin masa dhe realizojnë monitorimin e zbatimit të tyre për të garantuar mospërdorimin e burimeve njerëzore të institucionit në funksion të veprimtarisë së fushatës zgjedhore të subjekteve zgjedhore, të regjistruara për këto zgjedhje, në zbatim të nenit 14, të ligjit nr. 9131, datë8.9.2003, “Për rregullat e etikës në administratën publike”;
d) take measures to suspend from duty civil servants of their institutions, who have been registered as candidates for the general elections of May 11, 2025, in accordance with the provisions of point 4, article 63, of law no. 10 019, dated 29.12.2008, “Electoral Code of the Republic of Albania”, as amended, and of article 37, of law no. 152/2013, “On the Civil Servant”, as amended. For other civil servants, whose employment relationship is regulated by the Labor Code, measures shall be taken, as appropriate, for the termination of the employment relationship or suspension from duty in cases where they are found to have been registered as candidates for the general elections of May 11, 2025.
The Department of Public Administration takes the necessary measures to not publish vacant civil service positions in state administration institutions during the election campaign and to suspend all phases of recruitment processes in the civil service in state administration institutions, initiated before April 11, 2025.
Public institutions and joint-stock companies, part of the state administration that employ employees whose employment relationship is regulated according to the provisions of the Labor Code or other specific legislation, other than that of the civil service, suspend the recruitment and appointment procedures of civil servants/employees for the period March 3, 2025–May 11, 2025.
Recruitment procedures initiated in these institutions before March 3, 2025 continue to be concluded, but, in any case, before April 11, 2025. Exceptions to this rule are exceptional cases when, due to a lack of personnel, the continuity of the provision of services to citizens by critical infrastructure institutions, health, education and defense, is affected, for which this obligation applies for the election campaign period.
Failure to comply with the rules and obligations provided for in this decision will result in disciplinary and legal liability, according to the applicable legal framework. /Pamphlet/
