Even today, the Special Court has not succeeded in making a decision to place former Prime Minister Sali Berisha under arrest.
At 3:00 p.m., a decision was expected to be taken on SPAK's request for tightening the security measure against Berisha, but even today judge Irena Gjoka has not made a decision. The lawyers requested her departure and the judge gave them time, postponing the hearing for Saturday at 12.00.
Judge Irena Gjoka argued that the postponement of the announcement of the decision is done to give time to the lawyers who asked today to familiarize themselves with the audio recordings and the minutes of the last hearings held at GJKKO. The legal defenders of former Prime Minister Berisha claim that Judge Gjoka has been biased towards their requests, so she has requested the availability of audio materials and minutes of the session.
Berisha is accused of corruption with the privatization of the former "Partizani" complex. The GJKKO initially imposed an "obligation to appear" against him, while an arrest warrant was issued against Berisha's son-in-law, which the Appeal then also left Jamarbër Malltez under "house arrest". But Berisha challenged justice. He refused to comply with the security measure and SPAK addressed a request to the Assembly, requesting that his immunity be lifted. The Assembly accepted the request and SPAK asked the GJKKO for "house arrest", as well as security at the door with a policeman and termination of contact with people outside the family.
It was expected that the decision would be taken yesterday, but the session was postponed until today, as judge Irena Gjoka found herself unable to announce the decision, following the request made by the lawyers for her exclusion. But it seems that even today the session failed, as the lawyers claim that they have 3 days to argue the request for the dismissal of the judge and the Court has given them the necessary time.
Sali Berisha and Malltezi have been charged for abuses with the privatization of properties in the former "Partizani" complex. The prosecution states that the former prime minister has committed the criminal offense of "Passive corruption of high state officials or local elected officials provided by article 260 and 25 of the Criminal Code."
While Malltezi is suspected of having committed the criminal offense of "Passive corruption of high state officials or local elected officials".

As for Malltezi, the prosecution declares in the file that: Privatization of the grounds and sports facilities was done with the sole purpose of being shot in the hand, changed destination and used for material benefits by Malltezi;
The changes made regarding the destination of the areas from sports to residential, which has led to the construction, from which Malltezi has directly benefited;
All the monetary benefits that Malltezi received as an investor from the company "Homeplan" sh.pk, without investing in the latter, benefits received before he was declared as a spouse in this company, the profits accumulated over the years of this company as well as those distributed in the following, after 2018, calculated in total in the amount of 672 976 832 lek or 5 420 345 euros. / Pamphlet
