Evi Kokalari has filed a lawsuit at the Court of First Instance of General Jurisdiction in Tirana against the Democratic Party, requesting the immediate suspension of the electoral process for the election of the party's chairman.
In her request, Kokalari requests that the Court immediately suspend all actions of the Commission for the Organization and Control of Electoral Operations (KOKOE), as well as any other body of the DP related to the organization, administration and development of the electoral process for the Party Chairman.
This includes any decision-making that violates the principle of free competition and equal opportunities, until the final resolution of the issue with a final decision. It also requires the suspension of the legal effect of any decision-making taken by KOKOE or other party bodies within the framework of this process, including the announcement, approval or administration of candidates for Chairman.
The request also extends to the suspension of the entire electoral process, including the preparation of procedures, the organization of electoral structures, the holding of the vote on May 23, 2026, as well as the announcement or certification of the result.
Finally, Kokalari requests the suspension of the production of any legal consequences arising from the actions and decision-making of this process, until the Court issues a final decision, so as not to legitimize or consolidate the electoral process under the current conditions.
This legal initiative comes after KOKOE disqualified Kokalari and several other candidates such as Mereme Sela, leaving Sali Berisha as the only approved candidate.
"In accordance with Articles 202 et seq. of the Code of Civil Procedure, we request that the Honorable, after reviewing this request, approve the measure of securing the lawsuit by deciding:
a. Taking the measure of securing the lawsuit, ordering: The immediate suspension of all actions of the Commission for the Organization and Control of Electoral Operations (KOKOE), as well as of any other body of the Democratic Party of Albania, related to the organization, administration and development of the process for the election of the Party Chairman, including any decision-making that violates the principle of free competition and equal opportunities, until the final resolution of the issue with a final decision. The suspension of the legal effect of any decision-making taken by KOKOE or by other Party bodies within the framework of this electoral process, including, but not limited to, the announcement, approval or administration of candidates for Party Chairman. of the list of
Suspension of the development of the electoral process for the election of the Chairman of the Democratic Party of Albania, including: preparation and administration of electoral procedures; organization of the structures and acts necessary for the development of the vote; holding the vote scheduled for 23.05.2026; announcement, approval or certification of the election result.
