
The Constitutional Court has released the full decision on the matter of the dismissal of the Mayor of Tirana, Erion Veliaj, ruling in favor of the mayor and overturning the decisions of the Council of Ministers and the President of the Republic.
In the public plenary session of October 31, 2025, the Constitutional Court, presided over by Holta Zaçaj, examined the request submitted by Veliaj. By majority vote, the Court decided to accept the request and annul the decision of the Council of Ministers to dismiss the Mayor of Tirana, Erion Veliaj, as incompatible with the Constitution of the Republic of Albania.
Also, the Constitutional Court repealed the decree of the President of the Republic, "On setting the date of partial local elections", for the part related to the Municipality of Tirana, finding violations of articles 115, points 2 and 3 of the Constitution.
"The decision of the Council of Ministers, which was based only on the fact of the three-month absence from duty, did not analyze the cause, circumstances, nor the impact of the absence on the exercise of duty, failing to assess whether this situation resulted from the actions or inactions of the President himself and whether it could be considered a serious violation of the Constitution or the laws.
However, it should be noted that it is possible that failure to appear for duty for an uninterrupted period of three months constitutes a serious breach in the exercise of the mayor's duties, but always when he can and should be held responsible, unlike the specific case, where no legal responsibility is attributed to the applicant. In this case, the serious breach concerns the essential failure to fulfill the duty of his own free will, taking into account that the mayor is a monocratic executive body , "the decision states, among other things.
