The High Court has decided to dismiss the appeal of former Democratic Party candidate for MP, Aulon Kalaja, regarding the criminal complaint against the Council of Ministers for the decision to waive administrative fines just two days before the parliamentary elections of May 11, 2025.
Kala's original complaint was filed with the Special Structure Against Corruption and Organized Crime (SPAK) in May 2025. The subject of the lawsuit was the annulment of the Special Prosecutor's Office's decision not to initiate criminal proceedings dated 05.06.2025, as well as the obligation of SPAK to register criminal proceedings and continue investigations into the reported facts.
According to Kala, this government decision was taken in violation of the law, as such fiscal interventions cannot be made within a certain period before the elections, he claims that the law prohibits 4 months before the elections. He argued that this action directly influenced the election result, favoring the government in power.
The legal basis of his claims was mainly based on Articles 290 and 291 of the Code of Criminal Procedure, which regulate judicial review of prosecutorial decisions not to initiate investigations. However, after the case was dismissed initially by SPAK, then by the Special Court against Corruption and Organized Crime, the Supreme Court also decided not to accept the appeal, confirming that there are no criminal elements to initiate investigations.
