Prime Minister Edi Rama has chosen to give a response to the GJKKO and the Special Prosecution Office (SPAK) by using the statement of the American Supreme Court Justice, Robert H. Jackson, who is considered one of the brightest minds that democratic justice has known.
Rama has posted on social media a speech given by Jackson in the middle of the last century, but which, according to the Prime Minister, best fits the situation in Albania.
"When the prosecutor seeks the man before the crime, justice dies and when one power enters the territory of another, the democratic Constitution no longer breathes, but suffocates," is one of Robert H. Jackson's quotes, used by Rama.
"As for me personally, he has taught me something very inspiring about moving forward, only forward, which none of my detractors understand and will never be able to understand, as fortunately most Albanians understand very well. This is the major lesson of his monumental expression, "power has never been more worthy than at the moment when it has agreed to submit to the judgment of an independent justice"," Rama writes.
The Prime Minister's reaction comes at a time when he has addressed the Constitutional Court, asking it to urgently repeal the security measures against Deputy Prime Minister Belinda Balluku, against whom the Constitutional Court, at the request of SPAK, is seeking suspension from government functions.
This is considered an interference of one power against another, more specifically of the justice system against the executive, creating a constitutional clash between the two powers. This is the reason why Rama, in his capacity as Prime Minister, and the Government have addressed the Constitutional Court.

I have long been impressed by the monumental figure of Robert H. Jackson, one of the brightest minds that democratic justice has known.
As Attorney General of the United States, Supreme Court Justice, and architect of the prosecution at the epochal Nuremberg trial, he established the moral foundations of the prosecutor's role in a modern rule of law.
His words, spoken in the middle of the last century, remain a guide for anyone who believes that justice should be independent, but never unaccountable; strong, but never blind to constitutional limits.
Dhe po e ndaj sot me ju, fjalimin historik të Robert H. Xheksonit, sepse paralajmërimet e kryeprokurorit legjendar të Amerikës, njeriut që shkroi etikën moderne të prokurorit demokratik, tingëllojnë sot si të shkruara për ne.
Robert H. Xheksoni i mësoi botës demokratike se kur prokurori kërkon njeriun përpara krimit, drejtësia vdes dhe kur një pushtet hyn në territorin e një tjetri, Kushtetuta demokratike nuk merr më frymë, por mbytet.
Ndërsa mua personalisht, ai më ka mësuar diçka tejet frymëzuese për të ecur drejt, vetëm përpara, të cilën asnjë prej baltosësve të mi nuk e kupton dhe s’ka për ta kuptuar kurrë dot, siç fatmirësisht e kupton fare mirë shumica e shqiptarëve. Ky është mësimi madhor i shprehjes së tij lapidare, “Pushteti nuk ka qenë kurrë më i denjë sesa në çastin kur ka pranuar t’i nënshtrohet gjykimit të një drejtësie të pavarur”.
Ja edhe fjalimi i Robert h. Xheksonit që ka hyrë në analet e historisë me titullin “prokurori federal”, mbajtur në prill 1940 në konferencën vjetore të prokurorëve të shteteve të bashkuara:
Prokurori ka më shumë kontroll mbi jetën, lirinë dhe reputacionin e një personi sesa çdo njeri tjetër në Amerikë. Liria e tij është marramendëse. Ai mund t’i vendosë qytetarët nën hetim dhe, nëse është një lloj njeriu i caktuar, prokurori mund të merret me deklarata publike apo me insinuata të hapura ose të fshehura. Por ai mundet të ndjekë edhe një mënyrë më të hollë dhe thjesht të marrë në pyetje miqtë e një qytetari. Prokurori mund të urdhërojë arrestime, t’i paraqesë çështjet përpara një trupe pas dyerve të mbyllura dhe, mbi faktet e tij të njëanshme, të ngrejë akuzë duke i imponuar qytetarit uljen në gjyq.
Po ai mundet edhe të tërhiqet pa shkuar në gjyq fare, duke ia hequr mbrojtjes çdo mundësi për t’u dëgjuar. Ose mund të vazhdojë me një gjyq publik. Dhe nëse jepet një dënim, prokurori ka ende mundësi të ngrejë pretendime për masën e dënimit, njësoj si avokati i mbrojtjes.
Ndërkohë që prokurori, në rastin më të mirë, është një nga forcat më të dobishme për shoqërinë tonë, kur ai nxitet nga ligësia apo të tjera motive të ulëta, bëhet një nga forcat më të këqia. Fuqitë që ai ka, i janë dhënë sepse prej tij pritet të jetë i pandikueshëm, pra absolutisht i paanshëm dhe kurrësesi i shtyrë nga përfitime personale, ambicie politike apo presione publike. Detyrimi i tij i vetëm profesional është “që faji të mos ia hedhë dhe pafajësia të mos vuajë”.
Por, ndryshe nga gjyqtarët, prokurori nuk është natyrshmërisht i pandikueshëm. Ai emërohet ose shpesh zgjidhet, dhe i vjen t’i tregojë publikut zellin e tij. Për të bërë karrierë, ai rend pas një bilanci dënimesh. Lejomëni ta them edhe një herë: prokurorit i është besuar një fuqi e jashtëzakonshme dhe i kërkohet një karakter i pashoq.
There is nothing a law enforcement system can do better than to avoid unnecessary hardship and unjustified prosecutions. If a prosecutor insists on a conviction in a case that should not be prosecuted at all, or tries a case in a way that is not fair, the damage he does is incalculable.
When the power of the prosecutor falls into the hands of a bad person, the prosecutor becomes the most dangerous person in a country.
One of the greatest dangers of abuse stems from the prosecutor's power to choose whom to prosecute. We've all heard the wise saying that the law books are so vast that a prosecutor can find any legal violation to charge almost anyone.
It is here - in the selection of cases - that the greatest temptation arises. The prosecutor can choose someone he does not like or someone he wants to embarrass, or a group of people who are disliked by the public, and set out to find them in violation. And it is at this point that law enforcement becomes personal, and the real crime becomes the fact of being disliked by the wrong prosecutor.
A good prosecutor can protect our people from crime; a bad one can terrorize them.
The application of the law is not automatic; it is humane. And while it is humane, it requires great restraint. The most dangerous power of the prosecutor is when he chooses those he thinks should be punished, instead of choosing the cases that deserve to be prosecuted. With the law books full of all kinds of provisions for crimes, a prosecutor has the chance to find at least one technical violation in almost everyone.
In such a case, the point is no longer to discover the commission of a crime and to seek out the man who committed it; the point becomes to choose the man to blame and then to search the law books, and to put the investigators to work, to pin a transgression on him.
This is precisely where the greatest danger lies, the risk that a public position will be used to humiliate, torture, or punish a citizen, not because they are guilty, but because they are unpopular or unwanted.
The qualities of a good prosecutor are as difficult to come by as those of a good judge. They are:
Honesty. Professional integrity. Impartiality. Courage and determination.
But above all, he must remember that his main mission is not to win cases, but to do justice.
Po pra. Nese relatori sander beci qe mori dosjen ne gjykaten kushtetuese, do sillet si Robert H. Jackson dhe do te kuptoje absurditetin e kerkeses se paraqitur kunder masave shtrenguese te B. Ballukut se ajo po akuzohet e hetohet si ministre dhr zv. kryeministre, e jo si deputete. Ajo nuk po e ushtron detyren e deputetit dhr as nuk po jep deklarata politike ose po ushtron voten si deputete, per te cilat nuk mban pergjegjesi. Autorizimi nga Kuvendi merret per arrest me burg, duke qene se duhet te jete ne proporcion me veprimet, por krimi eshte krim sikunder korrupsioni. Ne nje vend te Bashkimit Europian, doreheqja eshte e lidhur me integritetin e te akuzuarit. Le te provoje zonja qe nuk ka bere asnje shkelje dhe ska nevoje per la pompozitet dhe nderhyrje ne punet e drejtesise, sikunder me zdromsin e bashkise.
Zoti Rama te shkoje te Ligji i Lek Dugagjinit se hajdudi denohet dhe nga Populli
Po mor Ali Baba, po si i behet qe te gjithe duhet te jene te barabarte para ligjit ? Ti je duke vazhduar rrugen qe ka hapur Saliu per te mos u paraqitur par organeve te drejtesise. Pa le pa na mbahesh se drejtesine e re e paske bere ti. Rame te kane shkare shollet. Hahaha.
Theniet e ketij prokurori amerikan kane vlere vetem per vendet e perparuara. Ne kushtet kur Shqiperia eshte 2000 vjet larg ketyre vendeve dhe kur ketu eshte bere baterdia nga te gjjthe hajdutet majtas dhe djathtas me vjedhje e korrupsion galopant, me dijenine dhe miratimin e liderve te tyre. Rama duhet te heshtë e mos te na beje moral kot.
"Kur fuqia e prokurorit bie në duart e një njeriu jo të mirë, prokurori bëhet njeriu më i rrezikshëm i një vëndi" (Edi Rama). Z.Kryeministër! Prokurori që ka dhënë masën e sigurisë për miken tënde Balluku, të duket njeri jo i mirë dhe i rrezikshëm për vëndin? Për çfarë bën fjalë, për vetgjyqësi? Apo flet ashtu në përgjithësi? Për leksione dhe esse ka nevojë populli? Një të pashkollë e more në bashki dhe kur tu dha mundësia e ngrite aq pranë, sa sot kafenetë e Tiranës gumëzhijnë: bashkë kanë abuzuar në bashki, bashkë kanë abuzuar në qeveri, bashkë të bien. Kur korrupsioni arrin në nivelet e larta të qeverisjes ,mafia është në zyrë, si konsulente,këshilltare, bashkëvendimarrëse dhe bashkëpërfituese. Si ju duk shteti shqiptar Z.Rama, një kamardare që i fut një të çpuar dhe e hedh tutje në rrugë?
