Former Prime Minister Sali Berisha is asking for permission to leave his apartment, as he has been under house arrest since December 30 of last year.

Through his lawyers, Berisha asked to get permission to go to the Assembly.

The lawyers of the former prime minister Sali Berisha have addressed a request to SPAK prosecutors, to allow him to participate in the plenary sessions of the assembly.

The request was made yesterday, January 15, while it remains in the decision-making of prosecutors Arben Kraja and Enkeleida Millonai to accept or not the request, which was sent by mail.

The request is argued with the fact that Sali Berisha is presumed innocent, that he has the right to participate in the plenary sessions, but also an obligation towards his constituents.

According to the defense lawyers, if SPAK assesses that there is a risk of leaving, then the police can accompany him.

On December 30, 2023, the Special Court against Corruption and Organized Crime decided to replace the security measure with mandatory house arrest under police supervision against former Prime Minister Sali Berisha, a person under investigation for the privatization of the former Partizani sports complex.

The decision was taken by judge Irena Gjoka, president of this court, for which Mr. Berisha's lawyers had asked to be excluded from the judging panel, claiming a conflict of interest.

The Special Prosecutor's Office against Corruption and Organized Crime requested an authorization from the Assembly to strengthen the security measure against Mr. Berisha, because he refused to comply with the first mandatory appearance measure for several weeks, calling it unconstitutional.

The Special Court ordered MP Berisha not to leave his apartment and not to communicate with other people except those who live with him in the same apartment, while for the implementation of this measure it charged SPAK and judicial police services.

According to the procedures, police supervision foresees regular services near Mr. Berisha's apartment to follow his compliance with this measure.

Mr. Berisha's lawyers said that this decision will be further appealed within the legal deadline, but the communication restrictions for a deputy are, according to them, illegal, because they had to be done with an authorization from the Assembly.

The former prime minister under investigation, Sali Berisha, is suspected of passive corruption in cooperation with the issue of the privatization procedures of the former Partizani sports complex, during which SPAK suspects that he exerted influence and pressure with various acts, favoring the son-in-law his Jamarbër Malltezi, one of the owners of that land, which was quickly filled with a group of buildings.
