
Lawmakers will decide by vote in the next parliamentary session on the fate of the mandate of Socialist Party MP Vullnet Sinaj. It is learned that the Socialist MPs will use the latest opinion of the Venice Commission at the time of the vote to send the "Sinaj" file to the Constitutional Court or not.
At the meeting of the Socialist parliamentary group on Monday afternoon, it was affirmed that there is no political decision on this case and that all majority MPs are free to vote according to their personal judgment. This is also based on what is written, among other things, in the opinion of the Venice Commission.
The entire procedure in the Council for Rules of Procedure, Mandates and Immunity has been completed after numerous sessions where MP Sinaj himself was also heard.
At the January 17 meeting, the majority and the opposition, although each with their own report, came to the same conclusion, which is that the plenary session will decide whether the DP's request "for the determination of the invalidity and termination of the mandate of MP Vullnet Sinaj" will be sent to the Constitutional Court.
The democrats' vote is public, everyone will vote for the matter to go to the Constitutional Court for a decision. Meanwhile, the socialist majority is learned to rely on the latest opinion of December 10, 2024 of the Venice Commission, which, among other things, states that deputies cannot be dictated how they should vote. This stance of "Venice" will be used by the deputies of the socialist majority to be free in personal decision-making, whether or not the "Sinaj" file should go to the Constitutional Court.
This is a tactic that can be used by the parliamentary majority to protect their colleague. A defense that has been noticed in the interpretations given by socialist representatives in previous meetings of the Mandates Council.
