The court battle for the stamp of the DP is back. A year ago there was a strong court battle between Enkelejd Alibeaj and Sali Berisha, while this time there will be a showdown between Basha, Bardhi and Berisha.
Lulzim Basha in September of this year changed the statute bringing a storm to the DP, but this statute has gone to court to be registered and it seems that it will not pass so easily, as there will be an identical confrontation as the one a year ago.
Sali Berisha and Gazmet Bardhi have asked to be parties to the process. The "Reestablishment" group, headed by Sali Berisha, requested the suspension of the process with the argument that there can be no additional registrations, without solving the underlying issue of who the seal belongs to, a case that is in the Supreme Court. Berisha appealed the decision of the Appeal, which gave the seal to Alibeaja.
" The court has assessed that the participation of the parties is necessary, as they have an interest in the resolution of this process. At this moment, the court finds no reason to revoke its previous decision on summoning the parties to the process as third parties. Regarding the request of DP represented by the National Council, the court considers to legitimize their presence. Among the fees that the National Council has given to 7 deputies is representation in court.
The court estimates that the will of the National Council was to be represented by 7 deputies. These 7 deputies have the right to choose a lawyer. Under these conditions, the act of representation is in accordance with the law.
Regarding the third party, DP represented by the National Council, the court decides to legitimize the lawyers Marash Logu and Redi Ramaj in the process. Regarding the third party represented by the Reestablishment Commission, the court takes into account that it refers to another procedural moment of the DP. Taking into account the object of the judgment, the fact that it has as object the change of the statutory studies of September 2023, the court finds that the relevant authorization does not include representation fees ", said judge Niko Rrapi.
Representatives of the official DP in today's hearing at the Court of Tirana were Rezart Kthupi and Indrit Sefa. From the group of Gazment Bardhi were Marash Logu and Redi Rama, while from the group of Sali Berisha, Çlirim Gjata and Franc Nuri. Today's session was postponed to October 25, as Çlirim Gjata must present to the court a power of attorney representing the party led by Sali Berisha.
