Sali Berisha defies justice: The court's decision is unconstitutional, I do

It is an unconstitutional decision. I never implement it. Absolutely not, I will not show up...

Former Prime Minister Sali Berisha has decided to challenge justice. Today, the Special Court confirmed the security measure "obligation to appear" against him, forcing him to appear before the Bureau of Investigation twice a month. But Berisha declared in a program that he will not implement the decision and has no intention of appearing on Mondays at 10:00 a.m. near BKH.

" It is an unconstitutional decision. I never implement it. Absolutely not, I will not show up. It is an unconstitutional decision. It is a shameful political decision, which goes to a scale that has never gone before in the history of this country. Parliament should have been asked ," he said.

Berisha continues to teach the fact that he is a deputy and there can be no security measures against him. He has also given signals that the lawyers will appeal the decision in the Appeal, while it seems that he has no intention of recognizing any kind of decision as long as the Parliament has not removed his immunity.

" First, allow me to guarantee the citizens that I am ready to appear before any institution at any time that I am required without any hesitation. I have repeatedly stated for a long time that no matter what consideration you have for the person who is called for questioning, it should never be rejected because if this happens it goes to the pre-state stage. I have been president and prime minister and I am for the rule of law. But what happens there? A judge undertakes to write the Constitution on her desk. The most serious act that a prosecutor or judge can do is to write the Constitution by kicking the European Convention on Human Rights. So freedom of movement ", he said further.

Today, the saga of the judicial process in charge of Sali Berisha has ended. After two days of procrastination, the Special Court has left in force the security measure "obligation to appear" for former Prime Minister Sali Berisha.

The latter was taken as a defendant for the affair with the privatization of the properties of the former "Partizani" complex. SPAK accuses him of corruption and the security measure "compulsion to appear" was initially imposed on him, while his son-in-law, Jamarbër Malltezi, was arrested.

But while for Malltez the process was easily closed by confirming the measure, for Berisha there were obstacles. He was supposed to appear before the court for familiarization with the measure, but the process failed. The lawyers asked for more time and the hearing was adjourned until Wednesday. But yesterday there were obstacles again. Initially, Berisha's lawyers abandoned the session and this caused the court to appoint mainly Artan Simoni as a lawyer. But the latter also left after making several statuses on social networks that were interpreted as being for Berisha. Then the court appointed lawyers Jalldiz Kastrati and Rabije Cenalia to defend Berisha. The session was scheduled for 10.00, but was postponed to 15.00. But they also left and in the end he was represented by the lawyer Valentina Todoresku.

In the end, judge Irena Gjoka did not withdraw from the decision and decided that Berisha should appear before the judicial police of SPAK on the first and third Monday of every month.
