Is this SPAK really that infallible?

It's not the SPAK media's fault. Why didn't Dumani tell us what's happening with Frida Krifca, or with Olta Xhaçka, or with "21 January"...

As the head of SPAK, Altin Dumani, spoke in Parliament today about the pressures on the institution he leads, he mentioned "political, media actors and organized crime" as sources of pressure, raising the alarm about the risk that these factors pose to the integrity of prosecutors and the entire special structure.

But in trying to identify the real threats to SPAK's independence, Mr. Dumani risks slipping into another danger: confusing criticism with attack. Because when an institution like SPAK decides to mention the media in the same row as organized crime and political pressure, the idea is created that even legitimate criticism, even investigative reporting, is seen as a threat.

There is no serious evidence that the media in Albania is exerting pressure on SPAK. What exists is an increase in public interest in its decisions, in the protracted investigations in some sensitive files, in its often unclear positions on issues of national interest. This is not pressure, it is public responsibility.

Even the way SPAK acted towards journalist Elton Qyno is the clearest example of what happens when an institution seeks to close information channels, instead of clarifying them. The seizure of the work equipment of an investigative journalist, without minimal legal guarantees, was later overturned by the Constitutional Court itself. And rightly so.

This is a kind of institutional complacency: we don't want criticism. Is this SPAK really that infallible?

Why didn't Dumani tell us what was happening with Frida Krifca, what about Olta Xhaçka, what about Aruba and other scandals? Why was "January 21" forgotten? Why is the "McGonigal" file being held hostage? Why was Olsi's Xibraka closed?

So, when SPAK justifies itself with the fact that investigations are ongoing, the media will speak out, they cannot keep their mouths shut. The Constitutional Court's decision, both on the "Qyno" case and on the seizure of phones, was a slap in the face to SPAK, and SPAK, instead of apologizing, is "squatting".

In today's session we saw a variety of strange things, as Dumani got to the point where he was arguing with the deputies and was ready to fight. The Special Prosecution Office should undoubtedly have support, but we cannot shut our mouths against injustices. Dumani himself and many other prosecutors have begun to see themselves as "God", but in fact they are paid with citizens' taxes and the reality is that SPAK has made many mistakes.

In addition to the "Qyno" file, we have the "Buka" file against Ahmetaj, where the prosecutor himself, who is also running for the head of SPAK, admitted the violations. So, SPAK is not infallible and as long as there are violations and silence on the files, the media will talk. /Pamphlet
