
The Tirana Court will be the only court in the Republic of Albania that will review the requests of citizens living abroad and who express interest in voting in the May 11 elections.
The decision was made by the High Judicial Council, which also determined that the Court will be obliged to respond within 48 hours.
In this way, all those citizens living abroad, who cannot find their name on the voter list or who have been denied the right to vote, have the right to request registration and receive the right to vote through the address [email protected].
Everything will be done electronically, which means that the review of the claim will be done in the absence of the plaintiff.
For the first time in the May 11 elections, Albanians living abroad can exercise their right to vote by mail. The CEC registered over 220,000 voters, while others who may not find their name on the list or have been denied the right to register due to technical reasons or failure to complete documents in the correct format can turn to the Court.
Decision by the Supreme Court
The High Judicial Council, based on Article 147 and 147/a of the Constitution of the Republic of Albania, Article 25, point 8 of the Electoral Code of the Republic of Albania, as amended, Article 10 of the Code of Administrative Procedures, Article 61, point “ë”, of Law No. 115/2016, “On the governing bodies of the justice system”, as amended, Article 36 of Law No. 98/2016 “On the organization of the judicial power in the Republic of Albania”, as amended, as well as Decision No. 23, dated 24.01.2024 “On the creation of the “E-Mail Server” for the official electronic mail of the judicial system in the Republic of Albania”, and Decision No. 354, dated 11.07.2024 "On the approval of the regulation "On the use of official e-mail in the High Judicial Council and the Judicial System" upon the proposal of the Committee on Strategic Planning, Administration and Budget,
DECIDED:
1. Approval of the electronic platform "Microsoft Exchange Server" for the submission of requests online for voters who vote from outside the territory of the Republic of Albania.
2. Requests from voters voting from outside the territory of the Republic of Albania will be sent to the official address [email protected].
3. The court reviews and decides on the requests of voters who vote from outside the territory of the Republic of Albania, also through the electronic platform "Microsoft Teams", within 48 hours from the date of registration of the request in the electronic case management system.
4. The Court of First Instance of General Jurisdiction of Tirana is charged with the implementation of this decision. This decision is published on the official website of the High Judicial Council and enters into force on the date of publication in the Official Gazette.
