The High Inspector of Justice has requested disciplinary action against Judge Shkëlzen Liçaj, assigned to the Court of First Instance, General Jurisdiction of Saranda, following a disciplinary investigation initiated for serious violations in the fulfillment of functional obligations.

The investigation is based on 13 complaints about repeated delays in the disclosure of court decisions, which in some cases have been up to 4 years beyond the legal deadline. The decisions belong to the period 2021-2023, while two previous proceedings that have been merged into a single investigative file are also included.

The ILD report notes that:

The delays in disclosure are not an isolated episode, but a pattern repeated for three consecutive years, exceeding every legal and professional standard;

Violations have led to delays in the right to appeal, in the execution of court decisions, and the failure to timely obtain the expected product of a trial – in essence, a denial of justice to citizens;

The judge has only 5 years of experience in the system, but the violations were found in the 2nd, 3rd and 4th years of his tenure, which according to the ILD proves a lack of preparation and functional accountability.

Although the judge has been cooperative during the investigation, the ILD assesses that the violations constitute a "serious disciplinary violation", requesting the High Judicial Council to impose the following measure:

"Temporary salary reduction of up to 40% for a period not exceeding one year", based on articles 105 and 108 of the law on the status of judges and prosecutors.

This is one of the most severe disciplinary measures provided for serious violations in the exercise of duty by magistrates.
