
Erion Veliaj has signed the dismissal of the acting mayor of Tirana, Anuela Ristan, from his cell, about a month after she was delegated her duties. This action has led to a clash between Veliaj and Prime Minister Edi Rama.
Lawyer Jordan Daci, invited to the show "The Unexposed" on MCN TV, has explained the reasons why, even after this development, Veliaj cannot be dismissed from office.
He stressed that Veliaj's dismissal cannot be done without a court verdict of guilty, simply as a security measure.
" Mr. Veliaj cannot be dismissed even after 90 days. Considering the standards set in the case of Mr. Zef Hila and I were representatives in the Constitutional Court, and if Veliaj were to be dismissed, this would mean a public court hearing, where he could be defended by lawyers.
This would turn this issue into a legal battle between the Municipality of Tirana and the Council of Ministers, which I don't think interests either the government or Veliaj.
On the other hand, Veliaj's dismissal cannot be done without a court verdict of guilt, simply as a security measure. Today, there is no legal reason that could legitimize his dismissal. The Prime Minister can dismiss him, without respecting the procedure, only if the Constitutional Court were to accept what he himself decided, and find it unconstitutional.
As for the absence for three months, the law says that the municipal council can propose dismissal, but there is a problem again, as in the case of Mr. Berisha, the absence is not due to the fault or lack of desire of Mr. Veliaj, but for a reason beyond his control, so a justified absence.
