Despite the fact that almost 8 years have passed since the adoption of the constitutional changes in the justice reform, citizens continue to face the same problems, court delays, delays, corruption and questionable decisions.
The reform was made to give justice, but is justice being given? Attention is focused on SPAK and sensational arrests, but when it comes to ordinary citizens, has anything changed? After the reform, the main problems were court delays, corruption, bureaucratic delays, etc. But even today the same thing seems to happen.
At least this idea is given by the report of the High Inspector of Justice. Next to the ILD for the year 2023, an increasing number of filed complaints is observed, compared to the previous year. During this year, 879 new complaints were filed.
" At the end of 2022, 2,824 complaints have been processed, where 1,752 are complaints filed with the ILD and 1,072 are complaints from the backlog fund. The object of examination for the year 2023 is a total of 3703 complaints, including the complaints filed during this year (879). Of these complaints, during the year 2023, 2340 complaints were examined, of which 1268 are complaints filed with the ILD and 1072 are complaints of the backlog fund ", the report states. So, even though the reform is progressing, dissatisfaction with magistrates grows.

According to the report, out of 2,340 reviewed complaints, it follows that: 2,012 complaints were filed by natural persons; 327 complaints were filed by legal entities, namely: 218 complaints from public institutions; 92 complaints from private entities; 16 complaints from foundations and civil society organizations; 1 complaint from the media; 1 anonymous complaint, since the name of the complainant is not recorded.
" The complainants who turn to the High Inspector of Justice, have a geographical representation from all over the country, where the largest weight is the district of Tirana with 803 complainants (34% of the complainants), followed by the district of Vlorë and the district of Durrës, respectively with 227 complainants (10%) and 199 complainants (8.5%). While the counties with the lowest number of complainants are Dibër, Berat and Kukës, respectively with 46 (2%), 44 (1.9%) and 27 complainants (1.2%) , the report states.
The complainants filed complaints with the ILD Office, raising claims against the magistrates, judges and prosecutors. From the 2340 reviewed complaints, it turns out that 68% of claims were submitted to magistrate judges, 7% to prosecutor magistrates and 22% to judges and prosecutors together.
From the statistical information of the complaints reviewed during the year 2023, it is noted that the claims against the magistrate judges who exercise their duties at the Court of First Instance of the General Jurisdiction in Tirana constitute the highest number of complaints. Complaints against the magistrates of this court are 15% of the complaints examined in total, followed by claims against the judges who exercise their duties at the Court of Appeal of the General Jurisdiction, with about 13%. The ranking continues with the Administrative Court of the First Instance of Tirana, with about 6% of complaints examined in total.
As for the examined complaints, on the claims against the prosecutors, it turns out that for the prosecutors who exercise their duties in the Prosecutor's Office at the Court of First Instance of the General Jurisdiction in Tirana, the highest number of incoming complaints was recorded, with about 6% of complaints reviewed in total. The ranking continues with the Prosecutor's Office at the Court of First Instance of General Jurisdiction Durrës, the Prosecutor's Office at Court of First Instance of General Jurisdiction Elbasan, the Prosecutor's Office at Court of First Instance of General Jurisdiction Fier with about 2% each. For the prosecutors of the Special Structure Against Corruption and Organized Crime (SPAK), about 1% of the complaints examined in total were submitted.
Based on the examination of the object of complaints, it results that the problems or claims raised mostly by the complainants are: Complaints against unjust decision-making by magistrates during the examination of cases; Non-compliance with material and procedural law by magistrates; Allegations of procrastination of the trial by the judges but also procrastination of the investigative activity by the prosecutors; Claims for delays in the reasoning of court decisions.
In the meantime, it turns out that in the end, the ILD started a disciplinary investigation for only 25 cases, throwing the complaints in the bin. / Pamphlet
