A preliminary hearing will be held today at 11:30 at the GJKKO for the "Partizani" file for former Prime Minister Sali Berisha and his son-in-law Jamarbër Malltezi.

The matter has dragged on until now after Sali Berisha's defenders managed to delay it with their attempts after the May 11 elections.

Judge Floreja Davidhi is expected to decide whether to pass the case file for trial with defendants Sali Berisha, Jamarbër Malltez, Fatmir Bektashi, Xhimi Begeja and Andia Pustina.

In the last session, held on May 5, Berisha used another maneuver, producing a document through which he claimed that the preliminary investigation judge Irena Gjoka had been convicted in 2005 in Greece for forging travel documents. With this decision, the former prime minister's defense requested in the preliminary session the revocation of the decision for the invalidity of the evidence taken by Gjoka.

Berisha's defense claims that if the document regarding Gjoka's conviction is true, any decision made by the preliminary investigation judge lacked legitimacy. 

Also on May 13, the GJKKO rejected his second request for the disqualification of judge Flojera Davidhi regarding the Partizani file.

Sending the case to trial would be Berisha and Malltezi's first real confrontation with justice. Berisha is under "compulsory appearance" for corruption, while his son-in-law Malltezi is being investigated under house arrest, accused of passive corruption and money laundering.

'Partizani' file, defendants:

-Sali Berisha, former prime minister – is accused of "Passive corruption of high-ranking state officials or local elected officials", committed in collaboration with Jamarbër Malltez, as provided for in article 260 and 25 of the Criminal Code.

- Jamarbër Malltezi – the son-in-law of the former Prime Minister – is accused of “Passive corruption of high-ranking state officials or local elected officials”, committed in collaboration with Sali Berisha, after in agreement with the latter, by exploiting the power of the former Prime Minister, he managed to obtain irregular benefits! He is also accused of “Laundering the proceeds of a criminal offense or criminal activity”, provided for by Article 287, paragraph two of the Criminal Code

- Fatmir Bektashi - The builder is accused of "Active corruption of high-ranking state officials", provided for by Article 245 of the Criminal Code and 'money laundering'

- Xhimi Begeja - Malltez's partner, land heir and co-owner of 'Homeplan' is accused of 'Money Laundering'

- Andia Pustina - The financier who carried out all financial and legal operations of Homeplan sh.pk - Accused of 'Money Laundering'.
