The judge of the Special Appeals Panel, Ardian Hajdari, was found guilty of concealing assets and was consequently sentenced to 1 year in prison.
The court suspended the prison sentence and Hajdari was sentenced to 2 years of probation.
According to the investigation, he did not make accurate statements regarding several years of work as a lawyer. The former member of the KPA was suspended from office in February 2022. He was charged by the Special Prosecutor's Office for the aforementioned charges.
Hajdari was criminally charged in June 2020 by former magistrates Antoneta Sevdari, Elsion Sadiku and Ervin Metalla.
The former prosecutor of the Prosecutor's Office of Tirana Antoneta Sevdari, the former prosecutor of Korça Elsion Sadiku and the former judge of the Tirana Appeal, Ervin Metalla, who were dismissed from their duties during the re-evaluation process, have reported to the Special Anticorruption Structure not only Luan Dacin but also Ardian Hajdar for falsifying documents in order to be elected to the Revaluation Commissions.
According to them, unlike what he stated before the Ad Hoc Committee of the Assembly, Hajdari stated in his CV that he practiced the profession of lawyer from 2002-2004 and from 2006 onwards. So, for 13 years after that, the other professional experience as a lawyer in the Koman Hydropower Plant and the Municipality of Vau de Deja is not included in the group of professions provided for in the law.
The whistleblowers claim that Hajdari lied and declared false information in the Assembly when he said that he practiced the profession of lawyer for 17 years, at a time when he could not work as a lawyer in the administration and simultaneously practice the profession of lawyer.
The whistleblowers also accused him of "concealment of income", since he was registered for the first time with the tax authorities to practice the profession of lawyer in April 2007.
Earlier, according to the same, he was not registered with the tax authorities before this period and did not pay social insurance for practicing the profession of lawyer. Also, Hajdari was sued for the criminal offense of "refusal to declare, non-declaration, concealment or false declaration of assets, private interests of elected persons and public servants or any other person who has the legal obligation to declare".
According to the whistleblowers, Hajdari did not declare any income during 2017, while during the interview in the Assembly, in the capacity of a lawyer, he said that he represented and defended a very high number of court cases.
"There are suspicions that he generated income from the law during 2017, but he did not declare it in taxes and, therefore, he did not declare it in his property declaration either," claim the whistleblowers who raise questions about how they were afforded from him the living expenses and how the fixed taxes of the exercise of his activity were paid", says the report submitted to SPAK.
