Justice reform and the role of SPAK have been at the center of the fiercest political clashes in recent days, especially after the arrest of Mayor Erjon Veliaj, who was the first official of this level to be handcuffed in his office. After Veliaj's arrest, it seemed as if there was a deviation from the official line on SPAK between the two main political parties, but days later, both Rama and Berisha took their previous places in the trenches, on the topic of independence and the functioning of the Special Anti-Corruption Structure. Except that both narratives converge on one point; on the impact that the treatment of SPAK has on the outcome of the May 11 elections.
Edi Rama: SPAK is a result of the SP and is guaranteed by it
Prime Minister Edi Rama presents SPAK as a product of the Justice Reform, an initiative that he and the Socialist Party consider to be the greatest achievement of their government. According to Rama, SPAK is an independent institution, but at the same time, the only political force that guarantees its functioning is the Socialist Party.
On the one hand, Rama seeks to distance himself from accusations that SPAK is under his control, emphasizing that this structure was created based on the Constitution and not as a politically driven mechanism. On the other hand, he acknowledges that the Socialist Party and he personally are the guarantors of SPAK's survival, implying that without the government's support, justice reform would fail.
While responding to followers on social media this Tuesday, Rama removed the United States of America from the equation of SPAK's influence, explaining that the only support for the special prosecutors is now himself.
"America has withdrawn, as you have seen, from this work and if America had brought SPAK, now that America has withdrawn from this work, it would have taken it with it to America, but no. SPAK is here and SPAK has only one guarantee," Rama said.
However, Rama acknowledges that SPAK has entered a new phase, where professionalism must be improved and democratic standards must be respected. The statement, which warns of legal changes after the elections, is triggered by Veliaj's arrest in office and comes at a time when SPAK has launched a number of investigations affecting the highest levels of politics, including senior government officials.
This is why Rama warns that SPAK should not violate the freedoms and rights of citizens in the name of its independence, implying that there is a risk that this special prosecution will be abused as a tool of political pressure.

Sali Berisha: SPAK si instrument politik i Edi Ramës

A nuk paralajmëroi ai që do ketë se do ketë arrestime? A nuk dërgoi ai Belinda Ballukun për të drejtuar partinë? Unë socialistëve u thashë dje, lexoni pak për zogun sqepkëpucë. Ai zog ka një veti, ai zog ha zogjtë e tij”, u shpreh Berisha në një konferencë nga selia e PD.
Ish-kryeministri thekson se një sistem drejtësie që arreston kundërshtarët politikë për të favorizuar pushtetin nuk mund të quhet një sistem i pavarur, por një instrument represioni politik. Ai shkon edhe më tej duke cituar deklaratën e zv/Presidentit të SHBA-së, JD Vance, për të sugjeruar se arrestimi i liderëve të opozitës është një mekanizëm që bie ndesh me parimet demokratike.
Për Berishën, SPAK nuk ka ndjekur dhe nuk ka hetuar krimin elektoral, por është përqendruar në eliminimin e opozitës. Ai akuzon SPAK-un për dy standarde, duke argumentuar se ndërsa opozita goditet me akuza të rënda, përfaqësues të shumicës socialiste nuk përballen me të njëjtin trajtim nga drejtësia.
Në zgjedhjet e 11 majit, qasja e Berishës ndaj SPAK-ut është një përpjekje për të mobilizuar elektoratin opozitar dhe për të krijuar perceptimin se vendi po shkon drejt një sistemi autokratik. SPAK dhe ndikimi në votën e 11 majit
Nga njëra anë, Rama kërkon ta paraqesë SPAK-un si një sukses të PS-së dhe një institucion që po forcon demokracinë. Nga ana tjetër, Berisha e portretizon atë si një vegël politike në duart e qeverisë, e cila përdoret për të mbytur opozitën dhe për të krijuar një realitet politik ku pushteti mbetet i pakontestueshëm.

What is certain is that in the run-up to the May 11 elections, the clash over SPAK could prove to be a key factor in citizens' decision-making. If voters see SPAK as an institution that fights corruption, this will favor the Socialist Party and Edi Rama. In this sense, as contradictory as it may seem, the arrest of Erion Veliaj and the discovery of his staggering wealth helps the Socialist Party's victory more than it harms it.
Conversely, if Berisha's narrative of a justice system that has been thwarted gains ground, then the opposition could exploit this dissatisfaction to mobilize the electorate.
Given this, the future of SPAK will be determined not only by the actions of prosecutors, but also by how citizens will interpret its role in the May 11 elections. / Lapsi.al
