The court session in charge of Sali Berisha has failed again. For two days now, the Special Court has not been able to decide on the security measure against the former prime minister, who is accused of corruption with the privatization of the former "Partizani" complex.

The hearing for familiarization with the measure was scheduled for yesterday, but was postponed for today after the request of Berisha's lawyers. But even today there were delays and in the end the process failed. Initially, Berisha's lawyers submitted several requests, among which an interpretation was requested from the Constitutional Court as to whether Berisha's immunity should be revoked.

The judge, Irena Gjoka, rejected the request and the lawyers left the session. The judge then appointed Artan Simoni as the state-appointed lawyer and the hearing was adjourned until 19:00, giving time to the lawyer.

But he was accused of being biased. He has made several statuses on social networks against Berisha, and it is known that SPAK0u has asked the court not to be his lawyer, but to appoint another one. The judge accepted the request and asked the Chamber of Advocates for another lawyer. In order for the new lawyer to familiarize himself with the file, the session was postponed until tomorrow at 10:00.

" At the request of the Prosecution, in order to guarantee effective protection, the Court replaced the lawyer Artan Simoni with another lawyer from the list of lawyers mainly and gave him time to familiarize himself with the acts. The hearing will take place on 26.10.2023 at 10 am ," the court announced.

Initially, Berisha was represented in the session by lawyers Genc Gjokutaj and Sokol Mêngjezi. For more than 1 hour and a half, they argued with judge Irena Gjoka, claiming that the measure "obligation to appear" against Berisha is unconstitutional, since he has parliamentary immunity. 

It is also learned that Berisha's lawyers have made several requests to the court, but judge Irena Gjoka has rejected them. One of their main demands was to ask the Constitutional Court for an opinion on whether or not authorization from the Assembly is needed for the security measure against Berisha. But the court did not accept and they left the session as a sign of revolt.

" We submitted a request yesterday for the dismissal of judge Irena Gjoka and today we requested her to give us the audio material.

We have asked the Court to give us a copy of the acts. The court claims to have decided yesterday. Without familiarizing himself with the acts, he decided. We have asked the court to request an opinion from the Constitutional Court to decide on the legality of the security measure. He rejected this request. In this way we left.

The court is using instruments and excuses to not acquaint us with the acts. Don't ask me questions, you can ask them in Court (the lawyer answers the journalist's question).
