GJKKO today provides security measures for 9 officials and former officials of the municipality of Tirana regarding the 5D file.
A hearing is held today at GJKKO to determine the security measure for the 9 directors and former directors of the municipality of Tirana who are accused of corruption related to the "5D" file.
Mariglen Qato, Redi Molla and Taulant Tushe, the most important directors in the institution of the municipality, will appear before the court today.
Others will be known by the "Compulsory submission" measure. According to SPAK, Qato and Molla are de facto owners of the 5D company, which has won several tenders near the municipality. The investigation was started mainly by SPAK, then it was Belind Kelliçi who sent a new report for the 5D file.
At the request of SPAK, GJKKO yesterday signed 9 security measures for officials and former officials of the municipality of Tirana.
In the SPAK announcement, it is stated that Redi Molla during the time he was the Director of "Tirana Water and Sewerage" and Mariglen Qato during the time he was the Director of the Support Department at UKT announced the winner of the company "5D Konstruksion" sh.pk in 11 the tender
SPAK has evidence that this company was owned by 3 people who were fictitious partners, while the real partners and "De facto" owners were Mariglen Qato and Redi Molla, who had social ties and friendly ties. SPAK says that the company has been declared the winner in these tenders from 2016 to 2020.
Also, '5 D' was declared the winner and was favored in the tenders announced by "Tirana Parking" and "Tirana" Sports Club.
The accused are part of the file for which the SPAK started investigations in April 2023 for the criminal offenses "Violation of the equality of participants in tenders and public auctions" and "Passive corruption of persons exercising public functions" as well as the report that the opposition made a month after, May 2023. The 2 criminal proceedings were merged into a single criminal proceeding, numbered no. 75 of 2023.
In the announcement of SPAK, it is stated that Molla and Qato have owned this commercial company "5D Konstruksion" sh.pk' indirectly, using other persons, citizens Eduard Meta, Muhamet Petriti and Nestor Muhamellari, as fictitious partners in the registration acts. and the operation of the company.

Accusation - Suspect for criminal offenses: (i) "Passive corruption of persons exercising public functions", in 7 (seven) cases , from these 4 (four) cases committed in cooperation, provided by article 259 and 25 of the Criminal Code, according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021
- Refusal to declare, non-declaration, concealment or false declaration of assets, private interests of elected persons and public servants or of any other person who has the legal obligation to declare", committed in 5 (five) cases, provided by Article 257/a/2 of the Criminal Code.
2- Mariglen Qato - Former director of the Support Department in the company "Tirana Water and Sewerage" sh.a. Until recently, he also held the position of the former director of the IMT in the municipality, Security measure: Arrest with prison

6- Albano Janku - Directorate of Human Resources Planning in the municipality of Tirana - Security measure: Obligation to appear before the judicial police"

8- Eglantina Zere - Director of the General Directorate of Cleaning and Greening - Security measure: "Compulsion to appear before the judicial police" and "Suspension of the exercise of a duty or public service", provided by article 242 of the Criminal Code .Penal, suspending him from the public function "Director" in the General Directorate of Cleaning and Greening, in Tirana Municipality,

9. Deborah Keçi - Director of the Tirana Sports Club - The security measure "Compulsion to appear before the judicial police" and "Suspension of the exercise of a duty or public service", provided by article 242 of the Penal Code, suspended from the public function "Director" in the "Sports Club Tirana", near the Municipality of Tirana.
Suspected of committing the criminal offense "Violation of the equality of participants in public tenders or auctions", provided for by article 258 of the Criminal Code, according to the content of this provision before the changes made by law no. 43/2021, dated 23.03.2021 .
Preliminary investigations related to this criminal proceeding have not yet been completed, investigations continue for other criminal facts or for other persons who may be included in the scope of the investigation of this criminal proceeding.
