
The GJKKO has withdrawn to issue a decision, after the preliminary hearing regarding the SPAK file regarding the "Partizani" case was finally held.
In today's session, the last person to present his position was the lawyer for the company "Homeplan" and immediately after him, the GJKKO withdrew to make a decision on what will happen with the file.
The defense of the defendants in this process has requested the dismissal of the case and the invalidation of some evidence presented by SPAK. The Special Prosecution, on the other hand, has requested that the file be sent to trial.
It is now up to the GJKKO to decide whether or not the file in question will go to trial, after about 6 months from the moment SPAK filed it with the Court.
Former Prime Minister Sali Berisha, his son-in-law, Jamarbër Malltezi, and 3 other people are on trial in this case.
The first preliminary hearing was held on October 24, 2024, and for a full 6 months the process was postponed in various forms until today.
If the case goes to trial, this would be the first criminal trial of former Prime Minister Sali Berisha. The latter is under "compulsory appearance" security measure on charges of passive corruption, while his son-in-law is under "house arrest" on charges of passive corruption and money laundering.
From the privatization of the sports club where Berisha's son-in-law was the beneficiary, at least 19 apartment towers were built.
Along with Berisha and Malltez, businessman Fatmir Bektashi is also charged with "active corruption" and "money laundering." The "money laundering" charge has also been filed against Malltez's partner, Xhimi Begeja, heir to the land and co-owner of 'Homeplan', as well as Andia Pustinë, the financier who carried out all of Homeplan's financial and legal operations.
