Family wants Ervis Martinaj declared missing, Klodiana Lala explains why they

Mustafa Martinaj, the father of Ervis Martinaj, known as the "king of gambling" in Albania, has officially requested that his son be declared a missing person.

Journalist Klodiana Lala has explained the legal procedure that must be followed before a person is officially declared missing.

" The law provides that the court cannot declare a person missing immediately after the request is filed. A period of six months must pass, during which all verifications are carried out by the relevant institutions."

During this period, the court addresses state and law enforcement institutions with letters to request information on any data that may be related to the person in question.

In this case, the requests are sent to the Lezha Prosecutor's Office, which is investigating Martinaj's disappearance, the State Police, the Special Prosecutor's Office (SPAK), where Martinaj was a subject under investigation, as well as other institutions such as SHISH and INTERPOL.

If all answers are negative and there is no evidence or document proving that Ervis Martinaj is alive, then the court, after the legal deadline has passed, may decide to declare him a missing person.

"After this announcement, after four years from the date of the decision, family members are entitled to exercise property rights and other legal procedures arising from the status of the missing person, " said Lala on the show "The Unexposed."
