The Ministry of Justice has prepared the draft for the year-end amnesty for convicts. According to the draft, about 570 convicts will benefit.
The Ministry clarifies that criminal prosecution is terminated for the majority of criminal misdemeanors punishable up to 2 years.
In the meantime, all men and 1.5 women and minors who do not benefit from freedom like others, with the exception of those sentenced to life imprisonment, convicted of murder and subjects of SPAK, benefit from a 1-year sentence reduction.
Criteria for benefiting from amnesty
Excluded from serving the sentence:
- male persons, convicted by a final court decision, with imprisonment of up to 3 years or any other type of milder punishment, including a fine or one of the alternatives to imprisonment, for punishments given until 30.06 .2023, regardless of the time remaining on the sentence.
-female persons, convicted by a final court decision, with imprisonment up to 4 years or any other type of milder punishment, including a fine or one of the alternatives to imprisonment, for punishments given until 30.06 .2023, regardless of the time remaining on the sentence.
- male persons, sentenced to imprisonment, who, until the date of entry into force of this law, have not suffered from this sentence for up to 3 years.
- female persons, sentenced to imprisonment, who, until the date of entry into force of this law, have not suffered from this sentence for up to 4 years.
- female convicted persons, who, on the date of entry into force of this law, are equal to or over the age of 50.
- male convicted persons, who, on the date of entry into force of this law, are equal to or over the age of 65.
- persons sentenced to imprisonment, who, at the time of committing the criminal offense, were equal to or under the age of 18.
- All convicted persons, who do not meet the criteria to be exempted from serving the sentence, according to point 1, of this article, or, even though they meet the criteria for benefiting from amnesty according to this article, are not exempted from serving the sentence due to the prohibition criteria defined in point 1 and 2, article 4 of this law, the following is deducted:
-1 year and a half for convicted persons, women, and minors;
-1 year for convicted persons, men.
