GJKKO accepts SPAK's request, sends Lefter Koka and 11 others to court

GJKKO has accepted SPAK's request and has submitted for trial the file with 12 defendants for the Tirana incinerator, among them the former minister Lefter Koka.

In a press release, GJKKO informs that along with the decision to send the case to trial, the requests of the defendants Lefter Koka, Bledar Karoli, Erjon Murataj, Taulant Tusha, Namik Simixhiu, Valbona Ballgjini, Sidita Kopliku and Jetmir Llapaj, for abbreviated trial, presented at the preliminary hearing by the defendants and/or their defenders with a special act representation.

The Special Prosecutor's Office against Corruption and Organized Crime on 31.07.2024 submitted to the Court the request with the object: "Sending for trial the criminal proceeding no. 255/1 of 2020, in charge of the defendants Lefter Koka, Pëllumb Abeshi, Bledar Karoli, Erjon Murataj, Taulant Tusha, Namik Simixhiu, Etleva Kondi, Alba Thoma, Valbona Ballgjini, Sidita Kopliku, Silena Tola and Jetmir Llapaj".

In the session of 13.12.2024 (preliminary session), the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Rudina Palloj, after examining the claims of the parties, with decision No. 106, dated 13.12.2024, decided:
The acceptance of the request of the Special Prosecution against Corruption and Organized Crime, registered with no. 106, registration date 31.07.2024 with object "Sending to court the criminal proceedings with no. 255/1 of 2020";
Sending for trial the criminal proceeding no. 255/1 of 2020 of the Special Prosecutor's Office against Corruption and Organized Crime, against the defendants:
2.1 Lefter Koka, accused of committing the criminal offense "Abuse of duty", committed in collaboration, provided for by article 248 in relation to article 25 of the Criminal Code.

2.2 Pëllumb Abeshi, accused of committing the criminal offense "Abuse of duty", committed in cooperation, provided for by Article 248 in relation to Article 25 of the Criminal Code.

2.3 Erjon Murataj, accused of committing the criminal offense "Abuse of duty", carried out in cooperation, provided by article 248 in relation to article 25 of the Criminal Code.


2.4 Taulant Tusha, accused of committing the criminal offense "Abuse of duty", committed in collaboration, provided for by Article 248 in relation to Article 25 of the Criminal Code.

2.5 Namik Simixhiu, accused of committing the criminal offense "Abuse of duty", committed in collaboration, provided for by Article 248 in relation to Article 25 of the Criminal Code.

2.6 Etleva Kondi, accused of committing the criminal offense "Abuse of duty", committed in collaboration and "Removal of the prisoner from the place of stay" provided by articles 248 in relation to article 25 and 323 pg 1 of the Criminal Code.

2.7 Valbona Ballgjini, accused of committing the criminal offense "Abuse of duty", committed in collaboration, provided for by article 248 in relation to article 25 of the Criminal Code.

2.8 Sidita Kopliku, accused of committing the criminal offense "Abuse of duty", carried out in cooperation, provided by article 248 in relation to article 25 of the Criminal Code.

2.9 Bledar Karoli, accused of committing the criminal offense of "Abuse of duty", committed in collaboration, provided for by Article 248 in relation to Article 25 of the Criminal Code.

2.10 Alba Thoma, accused of committing the criminal offense "Abuse of duty", carried out in cooperation, provided by article 248 in relation to article 25 of the Criminal Code.

2.11 Silena Tola, accused of committing the criminal offense "Abuse of duty", committed in collaboration, provided by Article 248 in relation to Article 25 of the Criminal Code.

2.12 Jetmir Llapaj, accused of committing the criminal offense "Abuse of duty", committed in collaboration, provided for by Article 248 in relation to Article 25 of the Criminal Code.

Together with the decision to send the case to trial and the acts of the trial fascicle, the requests of the defendants (1) Lefter Koka, (2) Bledar Karoli, (3) Erjon Murataj, (4) Taulant Tusha are sent to the court of origin. , (5) Namik Simixhiu, (6) Valbona Ballgjini, (7) Sidita Kopliku and (8) Jetmir Llapaj, for summary judgment, presented in preliminary hearing by the defendants and/or their defenders with a special act of representation.
Based on the provisions of Article 332/e of the Criminal Code, the formation of the trial fascicle is ordered, which will contain (i) the documents submitted to the Special Prosecutor's Office, together with the request for sending the case to trial (a total of 39 volumes together with material evidence); (ii) documents filed by the Prosecutor's Office in the preliminary session and (iii) the documents of the trial in the preliminary session.
Sending the case for trial to the Special Court of First Instance for Corruption and Organized Crime, to be drawn by lot to determine the judicial body of the foundation.
In reference to Article 332/gj, point 1 of the Criminal Procedure Code, no appeal is allowed against this decision.
