The High Court has overturned the decision of the Special Appeal for former prosecutor Aurel Zarka. The appeal, unlike the GJKKO, requested the requalification of the criminal offense as part of a structured criminal group.
The court sent the case for reconsideration by another panel. The Special Appeal decision was appealed by SPAK and by the defendant himself.
Zarka appealed the decision that overturned his sentence of 2 years and 8 months in prison in the first instance, requesting an aggravation of the criminal offense as a structured criminal group, arguing that it could not aggravate his criminal situation.
