The Assembly is expected to return to work on filling the last vacancy on the Constitutional Court, that of Elsa Toska, who resigned in September 2024. The Laws Committee will open the competition on December 10, and the mandate of the new judge who will be elected by the Assembly will be full (9 years).

Why was the process of replacing Elsa Toska delayed?

Elsa Toska's replacement caused a stir last year after the Assembly opened the race for a full-term member, but that was suspended by the Constitutional Court. The Assembly halted the proceedings until the Constitutional Court finally ruled that Toska, Zacaj and Bejtja should not have a full, but a partial mandate, to guarantee the renewal or partial refreshment of the CC.

The Assembly waited for the CC to justify this decision, but as the official decision has not yet been made public, the Assembly decides not to waste time, but to use the provisions of that decision, which are public, to move forward.

We recall that Elsa Toska's replacement is the last of the trio of three judges who were part of the renewal scheme this year.

How does the procedure work?

The Assembly opens the competition and candidates have 1 month to express interest. Then they are evaluated and ranked by points by the Judicial Appointments Council (JAC).

The Assembly, if it has 84 votes, can choose one of the 3 names with the most points, otherwise the candidate ranked first by the KED automatically becomes a judge.
