The "Partizani" file will be transferred to the Special Court for the assessment of the acts of the file in a preliminary hearing, where it will be decided whether the case will go to trial or will be returned to SPAK for further investigations, or dismissed according to the procedures that the Criminal Code also provides.
The Special Prosecutor's Office has announced that it has finished the investigations, it has communicated the charges to the defendants, the former prime minister Sali Berisha, his son-in-law Jamarbër Malltezi, the builders Fatmir Bektashi, Xhimi Begeja and the notary Andia Pustina.
According to the criminal procedures, after the signature is signed and the file documents are divided for the defendants, the material goes to GJKKO.
There the lot is cast for the judge who will take the case for review and will assess how the investigations were carried out by SPAK and whether there are irregularities or the need for completion.
Judge Irena Gjoka will no longer be the one who had the file until now, because this is what the criminal procedure provides. She has had the file of security measures and preliminary acts for over a year, leaving the measures against Berisha and Malltez under house arrest.
The judge for the preliminary session will be chosen by electronic lottery and there it will be decided how to proceed. If the judge accepts the acts of the SPAK file, then the trial is considered open and the review on the merits begins with the following sessions and the jury.
